Forclose in bankruptcy - timeline?

    Plant, I posted another thread but wondered if you knew . So does your 'rebuy' timeline start from the date of discharge, or when the mortgage company gets around to foreclosure? The attorney thinks it will be at least a year in our house from first missed payment (because CW is so overwhelmed w/them right now). We actually are more concerned w/getting it over w/and having the option to rebuy ASAP, and are worried that the foreclosure will drag on and hold us up by a few months.

      Not sure what you mean by 'Rebuy time'? I'm not going to talk to CW until I get a NOD, I tried before and they just shot me down. My payments are (were) 1575 and that's with a fixed 30 year at 6.12 rate with 40k cash down!. So even though I don't have a ARM and my house has only depreciated about 60k, I can't afford the mortgage. I bring home only 2k, sooooo I'm just gonna see how it plays out. Renting looks kinda good to me as if the plumbing burst etc, I don't have to pay for it.
      But since I did the bk my credit score is zilch, so saving for a sizeable deposit.

        Hey. Sorry. I meant, time period before you can buy another home/take out a mortgage. I know it's 4 years....but it sounds like the foreclosure might be dragged on for many months/close to a year. So can you rebuy 4 years from bankruptcy (that includes foreclosure) or 4 years from final foreclosure?

          Well, I'm even more confused since there are other threads in this forum where it's said you can not use your mortgage in the means test unless you reaffirm it.



          Too much conflicting information is very confusing.
