    Timing a foreclosure?

    I am currently behind one month on mortgage (1st and 2nd both with CHASE). I plan to file in June or July (after having baby). Id like to live inhouse as long as possible because I am considering moving out of state. So I dont want to find a rental before BK in case I move. Am I right to assume that the only risk with delaying securing a rental is the fact that my credit will be worse after the BK?

    ALSO - will I be able to live in the home throughout BK. What will happen in the given scenarios:
    1. What if foreclosure process begins before BK?
    2. What if it happens during BK process (after filing)?
    3. WHat if I am already discharged and then the foreclosure process begins?

    In each of these situations, how long will I be able to live in home rent free? What will it mean as far as discharging the loan debt? What about a deficiency judgement in each situation?

    I am in Nevada, where foreclosres generally take 6-10 months. I realize Chase is pretty tough. I know no one can give exact scenarios, but I am looking for the worst case scenario....

    I need to protect myself (against deficiency) but still make this situation work to my advantage so that I dont have to find a rental in case I move.

    Please help with any experiences...I am simply trying to gage my worst possible situation so I can plan that way, otherwise my family will have no where to live....
    waiting to file in july-august,
    waiting for Chase to begin foreclosure,
    waiting for cc's to begin lawsuits,
    just waiting (& "afraid")...

    My home is in Nevada too and my 1st loan is with Chase. I'm currently 3 months behind and they have not sent me the NOD yet. I think you can plan on being at least 3 months behind before they file the NOD... then you have 120 days before the sale, I think.

    So that would give you about 6 months from now at the least.

    I'm going to be filing too.... just to avoid a future deficiency judgment, no other reasons.
