    Home was on Foreclosure.com, now it's not!?

    This is strange...while going through my Chapter 7, I'm pretty sure my home was listed as a 'preforeclosure' on the site. I live on a small cul-de-sac. Most of the homes are older but kept up, so when I saw my cul-de-sac's name listed as a 'preforeclosure' I was pretty sure it was me.
    Since I'm in the waiting period of my Chapter 7 discharge, could that be the reason my house is no longer listed? I've never received a NOD and I just got another statement from CountryWide,it states that it is not an attempt to collect from me, but has retained the ability to enforce it's rights against the property should there be a default. it also says that if I'm in a Chapter 13 bankruptcy that i need to obey all orders of the Court,etc. Also if I don't pay my house payment by a certain date I will be charged a late fee of so many dollars.
    I'm confused, I haven't made a house payment since last August and thought for sure I would have gotten a NOD by now.Did my Chap. 7 slow it down? Will I have a few more months here? My house is very modest,built in 1980,no bells and whistles, bought it in 2004 for a little over 220,000. and it's now worth 170, owe 207, have a 30 year fixed at 6.1.
    Maybe because of the value, my home isn't a top priority or because there is over 500 foreclosures in my medium size,rural town? I'm in California in one of the hardest hit Counties of foreclosures.
    Any thoughts would be very appreciated!!

    I don't know how long it takes. We haven't made a payment since Nov '07. We had filed 13 a couple of months earlier. The townhouse is still in our name. I don't know what is going on with Countrywide. In September (08) we received a notice that the stay had been lifted. We rented an apartment in October because we didn't want to be stuck with no where to go once the house went into foreclosure. We had a few things left in the house that we were going back for here and there. We went last week to pick up some items and the lock had been changed. The front window screen was leaning against the wall and the old locks were on the ground. The back patio blinds were pushed open. I contacted the HOA thinking maybe there was a water issue, or some other reason, and they needed in there. They swear it wasn't them. I contacted my attorney thinking it must be the mortgage company. Attorney contacted Interval Mort (they service our loans for Countrywide). There bankruptcy attorney didn't know what was going on and said to contact there foreclosure department. Our attorney said that it is not listed on the court site as in foreclosure and asked me if we had received any other notification. I explained we have our mail forwarded to a P.O. box and we had not received anything else. I have been checking the sheriffs auction site daily since we moved and it has not been listed. They have sales listed through February 26. Also, the auditors site still shows it in our name. I don't know who changed the locks. My hubby thinks it was the HOA president. But there's no telling. I wonder if I could get a locksmith to take the locks of since it is still technically my property. The things left inside have no value to anyone but me (like a butter-churn my great grandfather made and family pictures.).

      Wow, thanks for the reply truckerswife...it's strange the way things work in foreclosure. I hope you are able to get your property out OK. Do you ever think about if you were still there making no payments? I'm going to stay as long as possible to save money but I have a nervous feeling all the time being here. At least when I do have to move it will be nice weather

        That's why we moved when we did. I was tired of wondering "is this the day we get the notice and if so what are we going to do?" . Also it was about 70 the day we moved. I don't regret moving. The house was falling apart. The repairman said the a/c wouldn't last another summer. Our shower leaked downstairs into the dining room. Our electric ran about $200 a month. Here we have on average paid $75 a month for electric. Of course I have more windows I can open and we are paying air/heat for one floor not two. I love my apartment. My only regret is I didn't move when I first filed bankruptcy. Well, that and that I thought I still had plenty of time to get my other stuff out. At least we weren't still living there when the locks got changed. I wanted to move out on my terms not theirs.

            I AM in the hardest hit County in Ca and the Nation for that matter! I used to subscribe to Foreclosures.com back when I was investing. They have up to date info but I have seen homes that are 6-8 months behind that don't show up as a pre foreclosure yet. I even saw a few that were foreclosed on and sold then they popped up.

              I don't get how that works.. do people try to buy the home from the owner before it goes into foreclosure? Is that how it works?

                Yes, there are those who will want to buy your home before the foreclosure happens. In most cases, this turns out to be a Short Sale, which we all know, can be difficult to get done sometimes. The other scenario is investors buy the home from the bank when the bank gets the home at foreclosure sale. Foreclosure.com is usually behind as Overmyhead states, so I don't see it as a good resource.

                  Then could that be what happened in our case (see above)? Wouldn't it still have to be in foreclosure before it could be sold? We didn't agree to a shortsale. I do recall seeing our address a few months ago on one of those list but I didn't pay the fee to see the "additional information".

In order to do this they basically bring the house current then sign paperwork to assume the loan.

                        BassBoy is right usually an investor will contact you to see if you would be wiling to sell to them before it Forecloses, sometimes if there is equity they can assume the loan and take over the payments too. In order to do this they basically bring the house current then sign paperwork to assume the loan and leave you on the paperwork, I would stay clear of this scenario. If you got to dump the place either short sale or sell traditional.

                          I would do a google search on lock bumping, you can probably open those locks yourself if you want to.
                          filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!
