Anxiety living in home.

I want to thank everyone here for helping me deal with such a stressful time.
I've learned so much reading of other peoples trials that it has helped me deal with my own.
In the last two years I've lost both my parents, divorcing, bankruptcy and now foreclosure,and I had just turned 50,yeah these are the golden years!
The chapter 7 went well, I'm in the waiting period, divorce is done, also in the waiting period, so now I'm living in my home that hasn't had a payment in 5 months, just waiting for the NOD. I do have a decent job and am saving my money, but I hate the uncertainty, waiting for the NOD. I have Countrywide and am hoping I can stay here as long as possible, but does anyone else feel the same sense of impending doom as I do? Hopefully this will all be a bad memory soon!

Hi Plantlvr, I totally understand some of your pain and anxiety.... not long ago me and my family of 5 were foreclosed on from our first home. It was one of the most painful experiences I had ever dealt with, next to the death of my mother. If I knew then what I know right now, the outcome would have been much different. And, I don't mean necessarily keeping the home, but selling the home for a profit before the NOD or order to vacate from the judge. I watched many Americans today just walk away... it was mainly due to ignorance, more than the will to fight and press forward!!!

Now, after 20 years and 8 BK's, yes I am filing my 8th BK as I write this reply... I have little to no anxiety because there isn't much "new" under BK!!! I can teach courses to newcomers, I've done this so many times. Please under stand I am not making light of yours or my situation, but thank God we have a BK system in this country. In some countries, you would not only lose your property, but your family and possible your life!!!!

If you are unable to manage a workout plan with Countrywide, which sounds like it's too late, since you already agreed in the chp 7 to surrender the property, maybe Countrywide will extend your stay for another month or two??? I would contact my attorney to ask about how long you have to remain in the home under the law. Because lenders are subject the the BK court, before they can make any moves. Also, the court must lift the "automatic stay" or grant Countrywide relief of automatic stay before they can even contact you. In reality you may have another 3 - 4 months until Countrywide will begin the foreclosure process. This hopefully will give you enough time to make more stable arrangements (i.e., moving into an apartment or rental home).

Just be encouraged you will bounce back... right now even though the market happens to be down in property values we (my family) live in a $420,000 home on a hill looking over the mountains. I thank God everyday for another opportunity!!! Just remember, this too will past..... Shalom!!!!

I am astonished! They must have been for various corporations and such, I don't even understand how the timeframe would work if they were personal BK's as there is a mandated waiting period between filings. If you don't mind, please tell us about your BK adventures.

Just a note - I already asked this question in another thread as I find it extremely hard to believe as I am sure others do also.

I feel your pain, we are waiting too and I have tons of anxiety, especially having four kids under the age of 10.

we do have a "relief of stay" court date for the mortgage people, it's on the 27th of this month. Our lawyer said that after that, we should get a letter from the sherriff and we'll have to be out 90 days of that letter. I feel a little better knowing they will not be at my front door demanding the keys.

I too am awaiting foreclosure. I havn't made a house payment to Countrywide since July. (July was the last month) We filed in October. On 12/23 Countrywide was granted a relief of stay from the court. But to date I have not seen any additional paperwork.

My attorney advised us our county move quick, and be ready to vacate about the end of January. (He told me this early December when they requested relief of stay)

However, after viewing all the county info, and looking at the foreclosures processed, they are doing courthouse sales 90 days after the court approves the foreclosure. Then I have an additional 10 days to dispute the sale.

In my situation... We're looking for the paperwork to go through, then will plan on relocating out of the area toward the end of the 90 day period. We may even to get a DIL to speed it up a bit depending on the time frame, or how fast they move.

i understand how you feel. DW and I could sit not and wait we wanted to stay and just save the money it was just to hard. We bought the house new had it built in 05. We thought that is were we would be for the rest of our lives. We were both divorced after 50 mine took 10 long years of fighting only to run out of money and had to give up.

I remember seeing a lady on the news a long time ago while filed bankruptcy 4 times and people couldn't believe it. EIGHT BK's?!?! WOW!!! You should be famous and be on TV as the Bankruptcy King!!
