    Leaving stuff behind during a Forclosure?

    I tried to do a search but nothing turned up!

    I have just two quick questions on forclosure if anyone knows?

    1. When vacating the property can you leave stuff behind that you don't want to drag with you? Can the mortgage company come after you and sue you because you left things like a couch and lumber behind?

    2. I came across a post on a random site saying to be ready to move out quickly because the mortgage company could offer you money "if" you leave right away, and or leave the property clean? Has anyone heard of this before?

    1. Yes, you can leave stuff behind. In the BK context, it doesn't much matter. But they can tack on some removal costs to your bill (assuming they actually go to the trouble to do so, most banks wont, they simply leave it to the next person to buy the house, or the realtor to clean up).

    2. Yes, those are called cash for keys programs. They are voluntary on your part, but some people on this forum have taken advantage of such programs.

      I would clean it up if needed, but I don't want the couch set I have and have no where to dispose of it. I figured if you had to leave in a hurry all kinds of stuff usually gets left behind.

      You say they can tack it onto the bill, when you forclose you get billed for it? I am going to foclose on a mortgage I did not reaffirm?

      This "Cash Key" program, does it exist for everyone, or does each mortgage company handle it differently. I am with Citimortgage, does anyone know if they offer this, and will they offer it on their own or do you have to seek it out?

        Well, any cost associated with the foreclosure gets tacked on to the deficiency, but since you filed BK and did not reaffirm, the cost is a non-issue as far as you are concerned.

        Cash for keys is lender specific, most mortgage lenders have such programs, it just depends on the area. You can call and ask, no harm in that.

            what about taking the dishwasher, stove, cabinets, etc when you leave. Would that be tacked on to the deficiency in the same situation as MARK80 and the cost is a non-issue because you did not reaffirm.

              lol, I can see where your going with that. I plan on leaving everything that was there when I had it built, since it was covered on the mortgage. However thats an interesting question!

                If its attached to the house, then it belongs to the house.

                Cabinets is probably pushing it. (Don't be that jerk).

                  I read an arcticle somewhere a few months back about a guy that was being sued by his lender because he had basically stripped the house before vacating...This guy took appliances, cabinets, light fixtures, even crown molding! Basically everything! I wouldn't go that route, just take your stuff and move on.

                    I could see people doing that, I agree only take what isnt attached. My Fridge and Microwave did not come with the house and I have to give those back to maytag. But I can't do anything about that or I would of left at least the microwave since its built in.
