Got four default notices!

    Wow.... I just don't understand why they send all these notices! IT is really a crazy thing! Best of luck to all of you.
    We haven't gotten a notice at all yet, however we are still under a bankruptcy stay, however I wonder WHY they have not applied for a relief yet. Gotta love the mortgage companies!

      Aren't they something to try and deal with? I remember in February when I spoke with a guy from the "Mod squad." Really nice guy, felt like he was understanding, on my side, looking for a solution....right up until the end of the conversation, when he said "Yes, I'm sure we can help you. Just keep making those payments and we can help you!"

      To which I replied "But...the reason I'm calling is, I can't make the payments..."

      He then said "You have to keep making the payments or we can't help you. If you're behind, we can't help you."

      Guess what? They can't help me! lol

      We also had been trying to work with them to modify, but ran out of time and filed, so that stopped that plan in its tracks...
      I really feel bad for some of the creditors I'm filing on, but not EMC.

        Ditto, Ditto, Ditto!! We sent all the info to EMC (more than once..) then got the whole "wait" "wait" and "wait" some more speech..all the while, daily, the calls from EMC's collections dept kept rolling in until I finally had ENOUGH...I had this real jerk of a guy who said something to me about my credit report suffering from this, and I just went ballistic..told him that was the least of my worries at this point. We were going round and round..EMC: "you need to pay this so we can continue to attempt your loan mod. If you're late, you'll need to start all over with a different department" Me: "But I can't make my payment, that's why I'm asking for a loan mod" WHAT PART OF I CAN'T MAKE THE PAYMENT ARE THESE YAHOOS NOT ABSORBING HERE??? !! I am soooo glad I made the 11th hour decision to NOT make that payment based on some very iffy chance that they were going to actually modify my loan, and used that money towards moving into a rental. Geezzzzzzz...what a losing game. Even the mod that was being proposed seemed like a lose-lose--interest only for 5 yrs, payment not much different than it currently was. To me, that just bought me 5 yrs, but at the end of that time, I'd have a mortgage of wayyyyyyyy more than the house was worth, and not a dang thing I could do about it. Oh, gravy friend, I do enjoy commiserating with you

          MORE arrived today by certified mail and so right now we've been sent 16 and had the 17th one taped to the door. There are three additional certified letters sitting at the post office, for a whopping total of 20 letters!

          That cannot be normal.

                The part where they don't get their money, I think.

                Very wise decision, I think, to cut your losses. I wish I had when I still had money. Last fall I thought if I could just get through the winter into spring, I could sell the house then and still be OK. Wrong answer

                Then between mid-December and mid-February, I had a 2 family deaths, another with a terminal diagnosis, and a child needing emergency surgery. I sorta stopped caring about saving the *^&%$ house, and I ended up taking a LOT of time away from work. I burned through my savings and by February, couldn't make the (over-inflated, I'm still bitter about) mortgage payment.

                I had some wonderful friends who got me through that time. At their urging, I called EMC, explained the situation, and asked if I could get a forbearance for a couple months to catch up. That was when they told me the phrase that will live in infamy: "Just keep making the payments."

                Uh huh.

                At my 11th hour, 2 of my friends came up with $8k between them. I guess they knew I was in no shape to deal with EMC, or be thrown out on the street right then. God bless them One called EMC and paid my Feb and March payment. If I knew then what I know now...I'd have used that money for better than paying EMC. It bought me some time, but only a little.

                I wrote letters and faxes, because I really prefer to have what's said in writing. First was never so much as acknowledged, and yet I'd get "threatening" letters back, saying I "had not contacted them." Not contacted? I called THEM, I didn't wait for them to call me!

                I wrote another letter, sending it certified. That was not acknowledged, either. Still they kept calling, writing letters saying I wasn't contacting them.

                The third letter I blew up. It actually came out pretty funny now that I think of it, because by them I saw the writing on the wall, so what did I have to lose? Might as well have the band play while the ship sinks, eh?

                I included copies of my other 2 letters (which were also faxed), and told them I was no longer available to them by telephone. They were welcome to email or write, but I am simply not available by phone.

                I had no legal grounds for that, but it worked and they not only did they acknowledge receipt of that letter (and said they would respond within 20 business days), they agreed not to contact me by phone anymore (and they haven't).

                When they did reply, around July 10th, they said "a modification for your loan was declined in May, due to inconsistent payments." Before February, I was never late. So pppfffftttttt to EMC. I feel bad about BKing on a lot of my creditors....but not EMC. I plan to stay in the house as their caretaker until I'm forced to leave. I'll get my equity back in free rent

                Maybe I should send them a bill for the new garbage disposal I just put in "their" house? lol

                  Nope, it's another one that is local to my region (It's right inside my city - not wanting to name where I am, you know?).

                  Anyhow, I'm a bit confused here. . . Do you think that possibly my mortgage may be in default? I'm not sure if that's what they're trying to tell me. Maybe a few more letters will clear up my confusion. (lol)

                      No worries, understood My servicer is nationwide. I guess I assumed most were.

                      When I chose my username for this forum, I chose something completely different than my usual username, so even if someone I knew came across it they wouldn't know it was me. I gave my location, but heh....I'm one of probably 100,000 in this area in the same situation. I'll blend in with the crowd.

                        OK, obviously my lender doesn't love me as much as yours does you, but I'm catching up! I just got 4 more, all sent certified. Add to the 5 sent regular mail.

                        This must be why it costs the lenders so much money to foreclose: they spend it all on postage
