    Got four default notices!

    Is it normal to be sent four default notices?

    The bank didn't attach any papers to my house, but instead sent four sets of defaults to a post office box I have. One is addressed to my dh, one to me, one to the spouse of my DH and one to the spouse of me.

    Is this the way it's typically done? Also, the mortgage is only in my DH's name and a few months after defaulting, my dh and I got our credit scores and his had plummeted but mine was still high, yet the notices are coming to me too. There won't be any mention of the foreclosure on my credit report, right, since I'm not on the loan? We are in a community property state.

      Indymac is the first lender, the one who sent the four letters.

      Wells Fargo is the second, but they haven't sent anything yet.

        Isn't Indymac the one the feds took over, that could have led to the 4 separate notices
        May 31st, 2007: Petition Filed by my lawyer
        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.

          I'd like to hear an answer to this one, too, as my name also isn't on the loan, but is on the title...hnhlvr--you and I seem to have a lot in common!

            Indymac sent me a FIFTH one today!

            JRScott, yes Indymac did get taken over by the Feds and now is "indymac federal bank" and that may possibly explain the situation, but still I'm unsure why I'm being sent the paperwork in my name too.

            Martha - I'm sorry you're in the same boat is me. I wish I could give you an answer regarding what'll happen with your default notices and whether your credit will go down because of it. I was hoping to see if mine stayed up, but a balance transfer check I paid to citicards bounced and now my interest rate has shot up and surely my credit has plummeted. I'm just hoping a foreclosure doesn't show up on my report so possibly I can buy a house in just my name later on.

            How late are you on your payments? Keep me posted and let me know if you get default notices in your name too.

              From what I have been told by some people who have surrendered their homes in bk, the foreclosure doesn't show up on your credit report. It just shows up as Included In Bankruptcy. Hopefully that makes you feel a bit better. We had the exact same situation!!

                Thanks, needingsomehelp, but unfortunely we have to wait at least a year to file BK so by doing so the foreclosure will show up on my DH's report.

                I just checked my fico (one of my credit cards just posted my current score) and it's down to 681, so the foreclosure hasn't lowered it. Two months back it was 733, then went down around 20 points in June and now it's down again as of July. All due to maxed out cards and now defaulting on payments.

                  I wish you the best of luck in all of this! It is such a stressful time for so many of us. Just try to remember that it will all work out, and someday we are hopefully all going to look back and realize that it was just a very important lesson!!

                    Thanks. More default notices have arrived and now there are *12* total. Surely more will arrive tomorrow. Very odd!

                      Just served. My wife too....Why? She is not on mortgage

                      I was just served yesterday. My wife as well. Why would she be served if she is not on the mortgage?

                        And I thought the loan servicer was on crack I got 4 today, all identical, all addressed to me. There's another on it's way that was sent certified (I wasn't home when the mail came).

                        They couldn't even bother sending originals of the lender's "We're here to help!" propaganda, they sent barely readable copies of copies.

                          Markorious and No Gravy - who are your lenders? Keep posting as you receive more notices! (I'm bored and need some form of entertainment).

                          There are four of the 12 above mentioned copies which are certified and sitting at the post office. When I check my PO box, I'm imagining it clogged with tons more.

                          Oh, and since so many copies have been mailed to me, does this mean there isn't a notice on the house? I cannot drive by to check this week since my kids would be in the car with me.

                            My lender is EMC Mortgage. And as a side note: I've been trying to work with them (or rather, get them to work with me), since February. Absolutely UNwilling to modify anything.

                            The notices came from the servicer, though. Quality Loan Service Corp. Looks like a real low-budget group.

                              ooohhhhh...No Gravy--yet another thing we have in common, my mortgage company is also EMC !! I will let you know the minute I start receiving anything, and especially if it mentions my name..We also had been trying to work with them to modify, but ran out of time and filed, so that stopped that plan in its tracks...
