    Surrendered House, BK Discharged

    I haven't heard from my lender yet.

    Do I need to call them and let them know that I surrendered the house in BK?? (I have only missed one payment so far)

    Wondering if I need to notify them or not.

    Did you state the house would be surrendered when you filed? If so, then there's nothing more you need to do. The lender will follow the necessary steps to foreclose.

      Thanks for the response.

      I did, but my file was amended 5 days prior to discharge. I had originally stated I would reaffirm, but due to circumstances, I changed my mind. I hope I didn't mess up anything.

        You shouldn't have messed things up at all. It may have delayed things a bit, but for the most part, the process should go as planned.

          Here's a scenario:

          Since I have surrendered, and my Bk is discharged, I still owe for July mortgage. Let's say I pay that in August, and pay August in October, will I push off the foreclosure until the end of the year in that manner??

          I am trying to stay under my roof for the next few months or so due to unemployment. Can't rent right now, and I'm not all together certain when the foreclosure will go, since I am only 30 days late and this is the first payment I skipped. (Yes, checking into homeless shelters for Plan C or D, checking into family in another state for Plan E).

          Anybody have any suggestions please?

            Okay, so your 30 days late. Usually, foreclosure proceedings do not start until you're 90 days late. Paying a little here and there to keep the payments somewhat current may buy you some time, but in all reality, you're flushing money down the toilet. DO NOT pay for something you're not keeping. Your mortgage payments can be put in the bank and keep you going until you find work and/or get you started off on the right foot when you're ready to move on.
