Ok short and sweet. We where in a repayment plan with our 1st mortgage. husbands direct deposit got lost due to we switched banks. Due to bank fault and our course us. Found direct deposit bank at it all in NSF so no money for mortgages. Call lawyer and nothing called mortgage company they will not talk to us. Will have the payment next week. Will mess up every thing but will have payment. What can we do? we have filed chapter 13 and lawyer is no help....I post the long story on chapter 13 board. any info would be helpfull.

they have to go to court to get the stay lifted before they can foreclose. do you have a pacer account? Then you would know about any filings a few days before the mail reaches you. Call your lawyer again. If no one will see you, like in the next few days, tell them you will show up and wait in their office until someone does, that you are at the end of your rope and need the legal advice you have already paid them for.Chapter 13 filed -8/12/04

See my reply posting to you in your long posting about this in the Chapter 13 forum. Also, they will not foreclose on you with just one late payment as arkienurse states. Get this straightened out with your attorney to get your payments and plan back on track._________________________________________
