    Help with Florida Foreclosure

    I stopped making mortgage payments in Palm Beach County in February (payment too high, house woth less than I owe, etc.). I got a notice from the bank last week that they are proceeding with foreclosure. I want to stay here as long as possible to take advantage of living without monthly payments to get my head back above water. I am worried that you only get 48 hours notice to leave. Is there anyway that I can know when that date will be so I can get a place and move with plenty of time to spare?

      Jffdvs, plan on being out by the date of the foreclosure *sale*. If you wait beyond that, you do run the risk of not getting a lot of notice. It is entirely safe to stay there until the actual foreclosure and deed transfer, because legally that must precede any eviction action, but beyond that sale date it really depends on the state law and how fast your county's court system is... who knows?

      So plan on being out by the date of the actual foreclosure sale, and you'll be safe from a sudden post-foreclosure eviction. Good luck!!!

      P.S. Gymbofreak, sometimes it IS a surprise -- after that deed is transferred, it's up to state law, and sometimes that state law only provides for a very short notice, and that by mail (it doesn't necessarily have to be posted, again that varies by state law) so it's not unheard of to receive an eviction notice within a few short days or hours of its expiration. Just so you know.

          In Florida you have 10 days past the sale date before the title transfers to the winner of the foreclosure auction, even if it is just the bank. After that a sheriff can remove you with only a 48 hour notice.
