    Countrywide Home Loans BK compliance...

    Looking for experiences with Countrywide as you filed for BK.

    I intend to reaffirm, and have yet to find any contact info for their compliance department.

    I have a fixed rate V.A. loan, and will maintain my payments through my BK but I have been unable to determine how I can do so assuming they will cease contact with me after my filing.

    Where did you send payments?

    Can you pay via Web Bill Pay, as I do now?

    Does anybody have contact info for a direct line to the BK department?

    Finally, how have you sent timely payments to Countrywide while you were in BK?

    We pay our first mortgage to our lender (Chase) every month using our bank's online bill pay feature. Gives us an objective and reliable disinterested 3rd party way to prove we paid them on time every month. I figure you never know when that might prove handy, especially with the shenanigans that some mortgage companies have been known to pull since they don't have to send you monthly accounting of your payment status while you're in Ch 13.

    One thing to do for sure at least once a year is to request a loan accounting in writing from Countrywide to ensure everything is what you expect to see. If they refuse, use the HUD RESPA letter to force their hand - http://www.hud.gov/offices/hsg/sfh/res/reslettr.cfm

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections

    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Thanks for that outstanding data.

      I'm trying to avoid the hassles of negotiating all the pitfalls that will develop as soon as I file, which looks to be the first week in July.

      I know that CW will no longer send statements, and perhaps even refuse payment.

      It's interesting that they can refuse payment, then turn around and foreclose for non-payment.

      I'd like to force payment on them, or at least sneak it in on them before they know it.

        We didn't get into the BK side with CW, but we did go thru Foreclosure proceedings with them. And it was not pleasant.

        I'd get one CS Rep on the phone who'd say there's nothing to do. The next CS Rep would tell me I could do something. The third would confirm what the 1st said and tell me the 2nd person was all wrong.

        It's hard to get contact info from CW. You can call regular Customer Service and they will connect you thru. But getting a direct dial phone number and extension is like pulling teeth from an unwilling victim with no anesthesia. Same for mailing addresses.

        If your luck with BK is like ours was with Foreclosure,......... CW will shut off your online Bill Pay access. That's what happened to us. Once we were 2 months late, we could no longer access our acct via the internet.

        Just guessing from our experience with them, you'll have one Tech assigned to handle your case/loan. We had a Foreclosure Tech assigned to our loan. Hopefully, you can get that person's name, direct dial phone number, and extension. Our Realtor gave us that information. The name, phone number, and extension. From there, maybe you can get a direct address to mail your payments to.

          This just fascinates me.

          So, if I petition the BK court and stipulate that I desire to reaffirm, why on earth would CW refuse to allow me to pay them?

          Is it their desire to foreclose?

          It makes no sense. How can I FORCE someone to accept my payment?

          What are my chances in court if the property trustee (deed of trust...Texas MERS loan) claims there is a default when in fact I have presented payment and it is refused?

          Seems that any mortgage company could foreclose on any property by simply refusing payment...

          Now Ford Credit can claim a "default" on a simple filing of a BK in court. It's actually in the contract I signed when I bought the car.

          I have yet to find anything in my Deed of Trust for my home that says a filing of BK is an automatic "default."

          Maybe I need to read further.....

            This is happening to us. We have Wells Fargo mortgage. I filed a Ch 7 on my own in May, my husband did not. They accepted our May and June payment but not our July and Aug. Now on the 2nd to last day for objections they filed a relief from stay. Now we are dealing with their attorney to get a re-instatement figure so we can square everything away. We have the money, they just won't take it. And now, we can't pay Sept either until we hear from them. I am suprised they didn't at least send a letter to us giving us a chance to get caught up and just threatening forcloure if we didn't once our discharge hit. We weren't even a ful 60 days behind. I have to call again tomorrow and I am hoping that they just give me the amount and when they want it by so we can move on. I am just praying they don't foreclose on us. Do they usually give you a chance to pay the arrears if you have the money before they go ahead and foreclose? You would think in this market they don't want to foreclose on people that have the money to pay them.... I hope.

                It's possible that the confusion is also coming form one of the home owners filing bk and the other one not. Most lenders will always move your loan to their bk department but if your husband did not file they might be having issues on where it's supposed to go, their normal dept. or their bk dept. Both my husband and I filed, we were discharged in February. We are also with Wells Fargo and unfortunately do to the mishaps of the lenders attorney our reaffirmation papers were not filed with the court in time. We haven't had any issues as of yet, I have their bk dept information and contact them regularly, while going through the bk we mailed our payments to their bk dept. Now I pay them in person at our local branch so that I may have a receipt showing it's paid and they also let us know that at any time we wanted to change to a online pay or direct debit from our account they would do that as well. So be sure you ask and clarify where it is your payment is supposed to be sent and how they are handling the situation of you having filed and your husband not. I believe that is probably where alot of the confusion might be coming from. Technically if you are both on the mortgage, you can't be in the regular dept. and he can't be in the bk dept. so it's in limbo and they don't which dept. is supposed to handle it. You definitely will want to get this taken care of as soon as you can. Document everything you have, and always make copies of your payment checks/money orders.

                  Mostly, they're afraid of the wrath of the Bankruptcy Court if they get caught doing anything that looks at all like trying to collect on a debt included in a bankruptcy.

                  I agree, it can be frustrating, but mostly it's just a matter of getting the address for the right department that knows what to do with your payment when they get it.

                  That's the other thing about big companies, they've got people specifically trained to deal with your exact niche sometimes.

                  Online billpay or certified mail with return receipts are two methods to undeniably show that you made your payments.

                    Hello friends, my loan is fixed rate, my monthly payment is fairly low, and I put down a large down payment. But it was my first home, and I find myself wondering if I had a "bad risk" loan or a normal home loan, after hearing constant talk about "the subprime lending debacle". How do you know whether the bank classes your home loan as a "subprime" loan? Any info will be appreciated.

                      My mortgage IS with Countrywide - call this #1-866-653-6183. I do still get monthly statements although they are usually received at or slightly after my bill is due - I pay on the 1st of the month through my bank's bill pay service online. I did have a few initial issues with CW with "reserve requirement".... if you encounter this problem I have the name and ph # of the woman you need to contact. Just be aware and really look closely at your statements and also if your insurance and taxes are escrowed in there.

                        I have a CW mortgage that's in curent bankruptcy.
                        CW doesn't reaffirm loans, therefore, you will either surrender the house, or pay it if you want to keep it.

                        I pay my mortgage thru my bank billpay, and they have never rejected it. However, I can no longer see my account details online, and they shut off my ability to pay online.

                          Mortgage reaffirmation...

                          I was under the impression that once you file your reaffirmation (at least in Vermont you have to reaffirm at the 341 if you intend to do so) that the stay is lifted for that creditor and business with them can resume as usual. Although I understand that some of them stop sending statements and will continue to not send statements even after discharge.

                          I also read in my Nolo, Chapter 7 book that statements that are listed in a loan document that say that you are in default if you file a bankruptcy are not given any credence by the bankruptcy court. You are protected by the stay whether the loan documents say that or not.

                            BK2008-could you email me that information? We just filed our BK and we have a CW mortagage-I am a little nervous about not having a reaffirmation letter from them. We're current on everything and our Att has assured us it's OK, but the trustee wants all the correct paperwork-

                              Our home equity line is through Countrywide and we never received a letter. I had to physically call and ask what their procedure was.

                              They don't do reaffirmations...at least that's what I was told. They just told me we had to keep current.

                              The only form of communiation we received was on our statement, telling us that if we didn't want to receive statements anymore to call them.
