    federal real property exemption

The statute, 522(d)(1), reads as though it only applies to real property used "as a residence." Does anyone know if this can be applied to real property the debtor DOES NOT reside in when the debtor doesn't have any other real property?
Comments are not, nor are they intended to be, legal advice. Replies to posts do not creat an attorney-client relationship. You should consult an attorney for advice regarding your individual situation.

No. (This is what we were told using Federal exemptions in a Michigan filing)

I'm not an attorney. My replies are merely suggestions or observations, not legal advice. As always, consult with an attorney before making any decisions.
