I live in Utah and am filing for BK here. Under Utah law, unemployment benefits are exempt. I asked my lawyer about this and he said I should still have my account be as empty as can be because Utah has no cash exemption. So I have been taking the money out. Not all of it has been spent. Do I have to spend it all or is it exempt regardless of what I do with it?
I am also wondering what will happen if I get a job, since Utah has no exemption for wages (they can take 25% but my lawyer said "keep the account empty still") if anything was left in the account. Would I have to report it at a 341 meeting? What would happen to my wages? I am very confused here, because according to UT BK law, the trustee can't take unemployment benefits and they can only take 25% of my wages, but my lawyer is telling me to leave my bank account bone dry.
