So if you go to Kelly Blue book to get an idea of the value of your car do you/they use private party sale or dealer sale? There is quite a difference ...

Every district requires a different valuation model. Some use KBB, some use NADA. In our district here in FL they use NADA RETAIL - which of course is no where near actual value. In order to fight the artifically high values, you can have an independent vehicle appraisal done if you show too much equity.

Your attorney will know which valuation model your district uses.
