A credit card company had their atty's file a lawsuit against me, but the judge dismissed it w/o prejudice because it was filed at the wrong venue. I want to try to work out a payment arrangement with this creditor so they do not refile the lawsuit, until I can pay my bankruptcy atty and get the Chapter 7 filed. I have a checking account that I very rarely use, so I was thinking about setting up the payment arrangement with this account, however, it is a joint account with my husband. (The creditor does not know that I have a husband).
Should I use this account to pay the creditor or would it be wise to open up an account only in MY name?
