    Court date today being sued by Portfolio

    I have a pretrial conference for today at 9am. I live in Florida my summons says that I must appear.
    The summons has attachments showing my last credit card statement from GE.

    I plan to file Chapter 7 in the next 2 months. I really do not want to show this morning. They have my last statement I don't feel I have any type of argument against that. But the summons says I'm required to appear in person. So does that mean I must appear? I'm confused I thought if don't show they just get a default. If I have to show I have no idea what to say.

    I would definitely show. Yes they would get a Judgement and if you can evade that now, your C7 filing will protect you. What to say? Either request more time, or ask for further information. OR, request an arbitration to settle. Sign nothing though until you file C7 and make sure your lawyer is informed.

    Your hearing is only the question do you owe this amount? Do something so that you will not get the Judgement. It is more hassle to get it removed. 'Hub

      I agree with Hubs. Def go and request more time. If you can save yourself the hassle of a judgment before you file by all means do so.
