Wells Fargo leaves me message about irreversible decision

    If it helps you at all, I was never sued by Target for a debt exceeding $10K.
    Are you saying WF is giving you another 15 days?
    You might want to keep the conversation going with them, it seems they are indecisive.

      Thanks catleg - it looks like they are - but so far I haven't talked to them...maybe a correspondence of some sort to them from me???now???may be in order?

        Ok........they just gave you another 15 days right? Once again, you still have plenty of time, don't bother calling them. Really, they are the only ones I answered. The idiot (could not speak english I swear) wanted me to sell my couch, ended up in an argument. That was the only time I spoke to any of them. You are already stressed, why put yourself through more, I assure you, my call was NOT pleasant.

        It will be mid-August before WF even gets it to a debt collector. As stated before, you'll get the letter, request DV and it will close or into Sept before any legal action get scary!!!

        Your gonna be OK!

          THANKS Sunshine!!! I'm more freakin' out than usual, because atty told me to stay under $X/month AVERAGE for July June and Aug for my salary. Well, I'm going to be about $27 AVERAGE over that. Can't help it. Bills have to be paid. So he'd better not say I can't do your BK because of $27 dollar difference! Anyway, I will owe IRS so I'll will have an IRS payment whcih does take away from DMI...

          Anyway - your advice - as always - is VERY welcome and is VERY VERY sound!

            Your welcome. I feel so relieved today and really really look forward to the day you are in my shoes!!!!

            I can only say again, don't talk to anyone, it's just more stress. Or really, when you know the filing date, call em all up and give em the attorney name.

            BTW: I think a 2nd grader typed my last post or maybe spelled my last few words LOL!!!!

              Thanks so much sunshinepa!!! Yep, when/once this is "all over" I may allow myself a few minutes of relaxation :-)

              I don't really have anything to say to them anyway...even if I wanted to pay them anything, there is nothing to pay them from...

                When I said continue the conversation, that could be as little as answering the phone and babble into it like you're retarded. Just so they know they can "reach you" so they will "keep trying" by giving you "one last chance". Otherwise they might think you've skipped and start calling neighbors, relatives if they think they can find them, etc.
                (I say this with no malice towards retarded people cause I sound like one on the phone too, when those robocalls come in from "your credit card" sometimes I hit 1 just for laughs and start babbling at them till they hang up, which is usually pretty quickly. Losing my voice is one of the most highly unexpected symptoms of Parkinson's that I wasn't aware of for years.)

                    Ok guys - UPDATE - yesterday I get a call on my (what else :-) Google voice that I need to return the call TODAY regarding the pending file that is in "my office" and I should call her back OR [get this] MY LEGAL REPRESENTATIVE. Wow - are they psychic? I expect that maybe they can see that there is a joint loan with spouse in spouse's Ch 13? Or did they just take a gander at my credit report???

                      If your spouse is in a ch13 and its a joint account and a consumer debt then you are protected by the codebtor stay.

                              I heard messages from Wells Fargo like this many times before they sold the debt to a junk debt buyer. "Mr. Down, your file is in my office and it is very important that I hear from you before 5 p.m. today, or else this file will leave my office. This is your last chance to resolve this matter voluntarily."

                              Sometimes they would call and when they got no where with me, they would tell me that I had better get an attorney to handle this matter because there would soon be "legal action" taken against me. Remember, legal action is anything that is NOT illegal, and doesn't necessarily have anything to do with a lawsuit. But it was scary back then.

                              They never sued me.

                              They sold it to a junk debt buyer, who has also never sued me.

                              I was told similar things by Wells Fargo. It was then that I realized that talking to any debt collector on the phone is usually a huge mistake. Not only are they getting a lot more information about me and my things than I would have ever wanted to tell them, they were making me very angry and upset. I concluded that the best way to handle debt collectors is to never speak to them. I started sending out cease and desist letters like mad. It doesn't work on all of them, but most original creditors and almost all third party debt collectors will voluntarily stop calling you once they get them in the mail.

                              It really reduced my stress once I figured out that I really didn't have to talk to them on the phone if I didn't want to talk to them.

                              And now with everything going through Google Voice, I can screen all of my calls, all of the time, and block anyone I don't wish to talk to. Fortunately, all of the collection calls have come to an end, but it still helps to screen out telemarketers, the debt collector's ugly cousin.
                              The world's simplest C & D Letter:
                              "I demand that you cease and desist from any communication with me."
                              Notice that I never actually mention or acknowledge the debt in my letter.
