They can't sue everyone. But they try to scare everyone into thinking that a lawsuit will be the next course of action if they don't hear from you immediately.
If I had a nickle for every debt collector who threatened me with "legal action" or said the "file was about to leave their office" and this would be my last chance to "voluntarily resolve this matter" if they didn't hear from me immediately, and then never followed through with a lawsuit, well, I could go buy a Whopper right now.
Huff and puff and bluff is their main weapon of choice against debtors.
It usually scares them into paying them something, and keeps the debt collectors employed.
If no one ever voluntarily complied with debt collectors, most of them would go out of business.
