If I have been sued by 2 collection agency can I include them when I file bankruptsy.

yes, normally you can. just list the doc. numbers, (there is a spot on your petition asking if there are outstanding judgements or suits etc.), if the creditors obtained judgments, after discharge file a motion to vacate the judgments.

When you file bk, you include ALL of your creditors, including the original creditors and every collection agency that has contacted you.

Thanks its hard to keep up with the collections. They keep being sold.

List what you have and don't worry too much about anything that got sold as long as the original creditor was listed. Their selling the debt over and over is not your problem.

Frogger is exactly right.
Just list the accounts with original creditors, as well as any lawsuits filed against you.
If there are collection agencies harassing you , you can include them on your matrix for "notification only".
It's impossible to know who's sold your debt to whom, so don't worry about that.
You are protected by the automatic stay once you file BK and woe be to the creditor who violates it.

ok have another question a collector keeps calling saying that i need to be home so that they could serve me papers. they leave a number just in case i want to talk to the attorney did not answer call. However their calling my relatives now. No one has come to my door that I am aware of, been home. I am waiting to file BK because I had overtime and not gonna work anymore ot. I'm wondering maybe their trying to get me to call them. How long do I have after they serve me' meaning how long can I put this off

Sounds like a scare tactic, typical in the life of collections. Don't stress to much over this. If you get served, then come back with the details and we'll see what your options are.

Somehow that seems so reassuring! Thanks, thats what I think I have to wait 6 months because I am working so much ot that they would just take it. I mise well stay home and only work my reg hours. However everything is coming to that 4 year line

Karm, hello! Did that myself with several P/T jobs - turns out I was shooting myself in the foot (or other appendage)...now I too have to wait a few months...

Is there a difference between a judgement and a lien? Do they both go on your property?Can I still file achapter 7 with them if i am current on my mortgage?
