    Sheriffs levy for credit card debt, call their bluff??

    I actually reached an attorney from Harrison Ross Byck, they are the attorney for CACH, LLC.

    I have a sheriffs levy for my personal items, I have no bank accounts only some personal items, which if sold will not even come close to the 9000 I owe.

    The attorney actually was pleasant, he said they dont want my stuff. The costs of picking it up and trying to sell it is a hassle. I actually told them if they dont accept my offer come and take my couch and my bed some old computers tv etc.

    Its actually not worth much more than the 2000 I offered sadly I am ready for them to take my stuff, the only issue is im told them can keep coming back!!

    You may have stated so in some other thread but bring me up to date. I will assume you have a Judgment against you and they are attempting to collect the Judgment. Is this so?

    IF so, I would call their bluff. IF you have a judgment, yes they can go on and on until the Judgment is satisfied. A Judgment is not a nice thing. If you C7 the Judgment can (with extra effort) be set aside. (Made not collectable or like discharged). Hope that helps. 'Hub

      What about your state exemptions? I am in Washington state and the state exemptions are something like $2500 for furniture, $2000 wildcard and $2700 for a car, $1000 for clothes. Check your exemptions out!

        Wow PA only has a 300 dollar state exemption, paying more than 2000, is just not worth it.

          Yes I do have a judgement, I waited to long, I tried to request a validation of debt through the court, I was completely ignored by the judge, JUDGEMENT granted. I never appeared in court my error. I tried to protest through the mail.

          I also tried contacting the FTC and the state attorney General, unfortunately bottom line they couldn't care less. The AG actually said they were to many complaints to investigate each claim, they will act if their is an overwhelming majority of complaints against a creditor, collections agents really do have freedom to rape and pillage, what good are debtors rights if no one is willing to enforce them. They are actually pissed off that I made it difficult for them!!! (creditor)


          The FTC really had no interest either, best they can do is a possible 1000 fine, for non-validation.

          I also spoke to an attorney, who said a case is possible, but a judge already ruled so difficult.

            C7 - Chapter 7.

            I cant really go C7 right now, my past business partner and I owned a home together, Ive used up all my equity, and can prove it on paper, but my attorney stated, you are never sure what a trustee can try to do, he might force my partner to sell the home, even if I can show I used up my equity, the home is free and clear, but I have been using the company account to pay all my bills which used up half the home value.

            I was coming off the LLC anyway, but the house could still be at risk, and my partner cant afford an attorney to fight it.

              We had a Sheriff's sale for our personal items for an unpaid trash debt, which I received a judgment. The Sheriff's came in and inventoried my items. Once we filed CH7, our attorney put a stay on the Sherrif's sale and my trash company can't touch my stuff.
              5/9/11 - Filed CH7 - No Asset
              7/1/11 - 341 Meeting
              9/1/11 - Discharged; 9/22/11 Case Closed

                Good God - for an unpaid trash bill? Are you in a small town, or do "Sheriffs" in PA have nothing else to do but to make people's lives more miserable? Where is Robin Hood...

                  Actually the Sheriff who inventoried my crap, couldn't have been nicer, he was almost embarrassed to be there, said he should be out chasing criminals.

                  Its amazing how banks have raped and pillaged with no consequences for their actions, and the mere citizens who fall on hard times, get raked over the coals.

                  Im ready for them to take my crap.

                  Hope it doesnt happen, as I rent and there are appliances that aren't on the sheriffs list. I'm worried about the recovery agent breaking in when i'm not home!

                    You're quite right - I think most decent folks would have a problem with doing this - and you are SO right about the banksters...I'm reminded of the Cook County (Chicago) Sheriff who stopped doing evictions for foreclosures...

                      No one can "break in" without a Court Order. The Sheriff notified you I am sure. A "recovery Agent" I am not familiar with the term, and even if he has authority, he cannot breach your home without your permission or your presence. That is "breaking and entering". 'Hub

                        The sheriff told me they can get a locksmith to break in after the sale, asset recovery agents, are used for just that to recover assets, quite a profitable business right now.

                            Always learn something new here...I would have never thought such small personal items would be gone after by lenders.
                            I guess it is because of the very lower personal items exemption in PA($300)!...still, most people's things are going to cost more to attach and resell, than what they bring at auction/sale.

                              I actually have a "Sheriffs notice property to be exposed for public sale" on Fri, May 20th.

                              Some one can bid on my stuff, I owe 9000. Offered 2000
