    tell creditors that I WILL file for Chapter 7???

    Hello everyone. Will be (fingers crossed) be filing for Ch 7 in...about 2 to 2.5 months.

    Lawyer gave us guide to tell creditors to call him.

    Question (which may be stupid) - if I start telling the gazillion phone callers to call my lawyer, don't give a "heads up" to the creditors? In other words, if I can deal with the gazillion phone calls per day, why would I tell anything to anyone until I actually file???

    Or is this totally stupid....

    A better questions is:

    "Why are you answering the phone?"

    IMO, you tell no one nothing.

      frogger...i'm with you on that one!

      but SOMEONE in this house enjoyed the calls.....actually had a few in tears...(the truth i swear)....

      i answered the first few times and then wasted my time with CD letter certified mail which all ended up in mail room twilight zone...

      we moved 1800 miles away....got a new phone...we thought GREAT......ceptin for this guy owned everyone and their mother and their mother's mother...and they wouldn't believe me when i said WE ARE NOT THEM!!!!! a bit of karma i guess!

      even now...after over two years discover called.......for the other person!

      there is usually no way to stop them other than to block the call..someway...even our atty..whom was so nice wrote them all as well....and i gave them the firms number they do NOT care until you get the actual "docket" number.

        I said nothing until i gave my lawyer a deposit and then i gave out his wonderful number lol.

          Thank you all!

          I know that's my situation NOKIA - lawyer cannot file till first week of MAY or so, so I figure WHY give anyone the "heads up?"

          Wife wants to answer phone and tell creditors, I'm like, that's what the answering machine is for - why put your cards on teh table TWO MONTHS early???? Does that make sense? Am I too paranoid???

            we had to wait 2 YEARS to file!!!!!!!!!! so i really understand...but we got new phones that could put the numbers on "block" and it was the best investment ever.

            your not too paranoid...LOL!!! it just goes with the territory...you'll be good to go soon enough...i know it seems like forever, but this is just the bumps you hit along the way..

              So - you think just don't say anything until stuff is actually filed? Phone will be burning - you see with the exception of one unsecured creditor - we're pretty current w/evertyhing else - even are (were) in a DMP...

                really if you do...the creditors still have a "legal" right to attempt to collect their monies.....no matter what.....however, once you file and get that docket number that are put on auto stay....and they cannot attempt to call, or collect or they are in big doo doo.....

                it just depends on your nature....personally, i didn't want to deal with it...turn the phone off at night and relax...until you file...that's what i would do..

                  Thanks TOBEE!!! That's kind of what I'm thinking - let them call and keep you cards close to your vest....

                  (I would LOVE to ask the atty but wife said don't email/bother him with stuff like this...sheesh - he's VERY expensive - he does nothing BUT bankruptcy for over 20 years - and I'm thinking why not ask...)

                    your in for a ride......and there are going to ups and downs...just keep it filed it will all be over soon.. and you're welcome...of course we are all here to support you!! so you are NOT alone!!

                      THANKS!! very much!!! (I think lawyer wants to catch them with FDCPA etc violations - he's got a "side" practice that sues creditors for $$$ for the such.

                        well....it's a good business and enough attys do not take advantage of "easy" money....since as soon as you file and the creditors continue to violate the stay....they get bucks...and you get atty fees to boot!

                            My lawyer does the samething, he said record them and keep a record of everyone that is calling and he will deal with them.
