    Midland Credit Management

    Midland Credit Management showed up on my CR in late Novemeber 10 for $504 dollars. Says it is an account opened in Nov 10 and is "severly past due/assigned to lawyer". I have still never received a letter from them, I have no idea who they would be collecting for as anything I had was for a lot more $$ than that. I waited till after Christmas and still no letter to me - no phone calls either. Same phone # for years that has been used on all applications/accounts, etc. No contact whatsoever. So I sent a DV letter the 1st week of Jan. Still nothing.
    Any advice on how to handle if I don't get anything from them in the next week? If you call them you get put on hold forever and transferred and hung up on. I am working on improving my situation, and this ghost account pops up.....

    Did you send your letter CRR? Or just first class 44 cent mail? If CRR, you should have proof that you asked for verification. Dispute the item with the CRA send them a copy of your DV request letter and the receipt for the mailing.

    If it reappears, I'd file a complaint with the FTC.

      Yes, CRR. I forget how long they have to respond?

        The FDCPA does not give any specific timeline when a CA must respond to your DV request. Midland must stop any collection efforts until they have provided you with verification. It sounds as if Midland has stopped collection actions. You could send them another followup letter. Otherwise, leave it alone. If they are reporting to your credit reports, then dispute the reports with the credit reporting agencies.

          Yeah they never really were active in their collection efforts anyways - just showing up on my CR. I will send another letter and copy it to the CRAs with my dispute, thanks.

            Midland was after me for awhile for an old zombie debt that was way past the SOL.

            I sent them a Cease and Desist Communications letter in the mail to them and never heard from them again.
            The world's simplest C & D Letter:
            "I demand that you cease and desist from any communication with me."
            Notice that I never actually mention or acknowledge the debt in my letter.

              $504 sounds like something along the lines of a telecom early termination fee or a bunch of bank NSF charges that have ballooned with penalties and interest to that amount. There's a claim in my BK case from Roundup Funding for $292 for AT&T Mobility charges. Damn wireless card never worked right anyway.

                Midland just bought several thousand dollars of our accounts just prior to our filing....HAHAHAHAHAHAHA. oops, my bad? no thats okay. sorry Charlie....err Midland. But heres the funny part. We got one letter from them dated like 1/3/11, stating they now own such and such acct, for $550. A few days later, i receive a letter from "atty's office" that represents midland's interest in the account, and low and behold that $550 balooned to just a tad over $700. How about that? idiots....eat it.
