    Will playing sick work for awhile?

    Hello. I am new to this forum.

    Now that the holidays are here, I am getting on the verge of losing my mind with the ongoing collection calls and collection letters, so I was just wondering do you think I would have any luck answering all of the calls, pretending that I am a family friend (checking the mail and telephone calls), and the person that they are looking for has been in the hospital the last two months and is gravely ill? Do you think that would at least maybe buy me some time & peace, just until the first of the year? I have a telephone voice disguise gizmo, where I can change the voice speaking through my phone to a young child, a woman, or a man with a deep voice. Yet since one company is calling a family member looking for me, I have to try to put a stop to that problem as well. Yet bottomline, do you think this plan (trying to fool my creditors into thinking that I am in the hospital in grave condition) will buy me some time & peace?

    At this point, there is no need to read the rest of my post, UNLESS you want to know the background of my problem. However if you can give me an answer to my question in the above paragraph, that is all I need. Thank you.

    If you want to read a little background of my problems, please do. I know that my first posting is very wordy, but I just need somebody to talk to that has or is going through a financial crises like me.

    I am over 6 months past due on several credit cards (AmEx, Citi, Chase, B of A, Wells Fargo). Thus far, I have been getting the usual collection calls and collection letters for over the past 6 months. However this month, some of my accounts have been turned over to the “PitBull” collection agencies. The way that I know about the “PitBull” collection agencies is because of two things . . . 1. These people (just this month) are leaving messages that they are calling to collect a debt (whereas before, none of the messages from the original creditors were every that specific or explicit over the past 6 months). 2. Upon checking out the phone numbers (via my caller ID) on Google and seeing the “800 notes, who called us, who calls me” listings, there are fairly current comments listed of how mean, harsh, rude, and nasty these 2nd string collection companies were to the people who posted comments when they actually talked with these companies. So these are the same new collectors that are now calling and leaving demanding messages for me. Yet basically I have taken the advice on this board (since about 5 months ago) of not answering the phone and letting the collectors leave a message. Today, one of the “PitBull” companies that only just started calling on Monday and Tuesday, just called me this morning and left a demanding message saying that if I did not return their call today, that they are going to turn my file over to their pre-legal department.

    Since it is the holiday season, I am almost totally broke, since I was self-employed, was living off of my savings. Yet since I was self-employed, I could not qualify for unemployment benefits. Yet now that the 2nd string of “PitBull” collectors are starting to call, I just am having a difficult time “mentally” trying to get to the end of the year. I am so down and depressed all of the time. Yet I have been unsuccessful trying to find a job over the past 6 months. It really is bad out there. So all I can get is part-time work, where I end up making minimum wage, with only being offered 6 to 8 hours worth of work per week. Yet I am so broke now, I can not even afford a BK lawyer to help me. Otherwise I would I would get a lawyer on retainer, to try to put a stop to the collection calls and letters madness. I live in Los Angeles, but I have not been able to find a lawyer that will do a BK pro bono. Yet out of curiosity, what happens when you get hit with a string of lawsuits, that you can not afford an BK lawyer? Right now, I know that if the "PitBull" collectors can not get any satisfaction, that the lawsuits will soon be on the horizon.

    I don't believe collectors will slow down their calls if they hear you are gravely ill. I'm so sorry your relatives are getting phone calls now. They may stop if you send the collectors a "cease and desist" letter telling them to only contact you by mail, and to never contact your relatives.

    Since you don't have enough income to pay your bills or retain a bankruptcy lawyer, you're "collection-proof". So, it doesn't matter if they take you to court, they won't be able to get anything out of you. If it were me, I'd change my phone number and only think about filing bankruptcy once I have more income. Good luck!

      I should start a foundation. Some of these stories are heart-wrenching.

        I wouldn't lie about being gravely ill. I'm superstious about that kind of stuff.

        Just send a cease and desist certified letter to each creditor. It worked for a few months for me.

          A collector does not care if you are sick or even dead. If you die, they want to collect from your estate.

              I don't think they will be sympathetic, they don't get paid to do that, only collect money. We got LOTS of calls when I was pregnant last year, and I told them I was sorry, but I couldn't work b/c I was high-risk, and after the baby was born I would return to work and eventually catch up with the bills. They wanted to know when that would be, and when I told them they suggested I borrow money from family/friends to pay them NOW. yeah, right. They called and called and called, one finally made me cry, and after that I stopped answering. Haven't talked to any of them since. Even if I did go back to work now, after paying for daycare for 2 kids, insurance, taxes, added costs for gas etc. there wouldn't be much money left to pay them right?

                i agree with the other PP'ers....collectors could care less about someone being ill.....actually they, the collectors would tell you to PAY them and not buy your medicine... that's how much they could care......

                i know it's a hard time when they call...but try an answering machine or block calling...it's far less aggravating....and it doesn't put you in a position to lie.

                  Gonebroke - may I respectfully suggest you seek some medical attention for your stress and/or depression? If you are broke, your local public health office can refer you to someone. If you need some short-term medicatlon and counseling, you can receive these free of charge and this may help you to see your situation more clearly, and thus, you will be better able to make good decisions for yourself and your future.

                  Now, about the finances...it is only money and not worth your mental health. Your creditors will continue their efforts to collect regardless of your health. But from what you post, you likely still have months before any legal proceedings reach their conclusion. You need to be actually sued, served, had your day in court, etc., all of which takes time.

                  Do you have any assets - you do not mention a home or mortgage. If your bankruptcy case would be relatively simple (non-asset) and you are able to concentrate, read, study and ask questions, (i.e., are not too depressed to function) you can file pro se (without an attorney) and you can ask the court to waive the fee for filing (you file in forma pauperis) and if the court grants your request, you pay nothing.

                  Keep reading this forum, ask questions, check your local bankruptcy court's website to look at the necessary BK forms, and hang in there. If you can't take the calls anymore, turn off the ringer and don't answer your phone. Get a tracfone and only give the number to family and friends, so you don't totally isolate yourself. If the mail is too depressing, get your mail forwarded to a PO box (keeping in mind sooner or later you will have to pick up that mail and deal with it - when you are in better emotional shape). Reach out to family and friends if you are feeling blue. And post here....everyone is very helpful and knowledgeable.

                    And yes, "you can file pro se (without an attorney) and you can ask the court to waive the fee for filing (you file in forma pauperis)."

                    You can file BK pro se and pay little or nothing to file it.

                    In the meanwhile, I think you would be better off not answering the phone when they call. If you can assign them a silent ring tone, do so. If not, just turn off the ringer for now, so you won't hear them calling you. They're causing you too much stress. And if you can, assign special ring tones for your family and friends when they call you. On a cell phone it fairly simple. You just set the default ring to silent, and then assign special ring tones to family and friends' numbers.

                      Thank you Everyone once again! I appreciate the additional help and support. I actually feel better now than I did when I first posted my message on the 8th. Now that Christmas is almost here, I have been receiving cards and presents . . . so that has been cheering me up a bit. Plus I have been reading other postings in this group, and I feel better that I am not alone.

                      Thus far, I have not answered a single telephone call, since it seems from reading this board, that those collectors (especially the second string of collectors, which I have been dealing with several different ones now since early December, whereas up to now, I had only been dealing with the original creditors and their in house collection departments) have a strong reputation for being extremely rude, mean, nasty, crude, threatening . . . and it seems that they would help a debtor prostitute out their own mother and sister just to get any amount of money. Yet 90% of the time, those companies just hangup and don’t leave a message for me. Yet when they do leave a message, it is always a serious, dry, but a business message. Yet the messages that they leave on my answering machine are always business like enough, where I could never use it in court to say that they were rude or threaten or harassing me. So I can deal with that. “Yet, I love those hangup calls from them!” As I HATE listening to those messages, so I can free up space on my answering machine. Yet since last Saturday, I have unplugged my answering machine, because I need a break from those messages, however I am keeping track of the calls via caller ID, because I feel better knowing which creditors and collection companies that are calling me each day. Yet I did pick up two new PitBull collection companies this week (based on my caller ID), when I read some of the feedback on “800 notes, who called us, who calls me” listings. As one seems to be a company that starts the legal proceedings for a creditor. YIKES!!!

                      Yet at least I now know that my plan to “play sick” is not going to help me buy some time per se. Yet I will take the advice that you all have been providing me, and I will continue to work to see if I can try to work myself out of this mess I have gotten myself into. Thank you so very, very much for your help Everyone!

                      No matter what happens, I do want to take this opportunity to wish everyone a safe, and good holiday season. As I know that some of us are going through a very rough financial time in life right now, yet at least we have each other, a great support system, and we do not have to go through this financial mess alone. So thank you for being there for me Everyone, and please know that I am there for the others out there who need or may need emotional support.

                      Most of all, thank you so very, very much Chicagoannie. Your help and advice is a great comfort to me during such a difficult time. I so appreciate you taking the time to provide me with such detailed and helpful advice, and I will use it. Thanks a MILLION!!!

                        re: gonebroke4no.... I lost my job as a museum supervisor over 2 years ago. I have defaulted on my 3 credit cards. My husband set up our fax to connect after the third ring on our home phone...I also have caller ID. I have yet to answer or talk to one debt collector...Just don't answer and please do not allow the bottom feeder debt collectors to ruin your day or waste your time...time is precious...good luck

                            If I answer the phone, I tell them "he will not be back till after 6:00 PM." That has stopped all of them so far.

                              FWIW, the collections people didn't care when my son inadvertently answered a call the day our 4th son was born, and told them I'd just had a baby and was in the hospital.
