    Delay

    Hey All,
Love this sight. I have 2 questions. Just got served a summons for a old cc debt. Does the 30 days it says I have start when I was served or the date it was filed at court? Also how is the best way to delay this? Just answering or are there better ways?
I'll be filing BK in a few weeks or so but would really like to delay this. Oh sorry just thought of a third question. What would the probable time line be for the summons, answer, asset seisure..... I'm in georgia.

Normally it's measured from the date served. To delay, you could call the court clerk and ask for a continuance while you search for a lawyer. That is easier and cheaper than filing an answer, if it works. Normally the sequence is complaint, default, judgment, debtors exam, wage garnishment/bank levy. But there's a lot of variance and it depends on your state. All that is certain is you're safe until the time period for an answer runs out.

The alternate sequence is complaint, answer, motion for summary judgment, summary judgment granted, debtors exam, wage garnishment/levy.
filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!
