I HAVE actually tried to answer twice, but they are not there when I do, and I refuse to wait for them to come to the phone. Thinking about it, having something filed against me is almost the scarriest thing to think about. I won't be able to file until the end of January, so if they, on average, go two months, that does not sound good for me.

Nerves acting up again. Not good.
pika...worse senario, i believe would be...this.....it's hitting thanksgiving time...honestly, the courts calenders are most likely really FULL about this time of year...additionally, they recess frequently due to the holidays...so FIRST you have to get served and given time to respond...SECOND...a court date is set up...ok, now i THINK we might be close to hitting FEB....by now...

i think you are in the clear..even if you were served tomorrow...you could even GO to court and stall it somewhat. at least until you file in jan.

The phone calls were relentless-from 8:01 in the AM till 8:59 in the PM 7 days a week. Somedays we'd come home to 45 plus hang ups on our answering machine. We just stopped paying most accounts in October-most are 2 months behind, and only a few are 3.
They were also calling my husband's work and my work (luckily our lines are private) all day, every day. It was only a short manner of time before our neighbors and family members got called.

We just retained an attorney, and every phone call (other than automated ones that call you but there is no one at the other end of the line) have graciously taken my attorney's name and number, and have not called back. The silence is so refreshing.... We were going to wait to file but am glad we did not. The peace of mind is worth it!

      February 2011: 2 months down....only 58 to go

mimindebt - have you actually filed yet or is it upcoming? I have attempted to answer calls from two different numbers, but there is NEVER anyone there, and, again, I am not going to sit around for minutes waiting for a person to pick up.

My calls begin around 8:30am and stop around 8:00pm or so, give or take. Usually every hour or two, but this is up from a few a day. I WANT to give them my attorney info, but, again, no one is ever there. Sigh.

pika...these people don't listen to anyone.

we had a wonderful atty...the firm took my creditors list and sent EACH one of them a cease and desist letter, included the firms contact information and that any further communication was to be directly to them.

no help...they didn't care at all...they just keep calling and sending letters. when i called our atty, we were told, that i'm not alone, that these creditors listen to NO one.

pika..i would either attempt to put a call block on the numbers and or just don't answer or turn the phone off.

          hope it all works out!

Well, sure they can call everyone and anyone around you. If you live in a city, where you're not really part of a community, you don't really have to worry about it. We live in an urban area, with a very popular last name.

And we do answer occasionally, so they know that they're getting in touch with us. That's why DH answers them occasionally. Besides, our family and friends will not think less of us, we just went through an 18 month layoff. We're not the only one with a layoff of our friends and family, most are completely sympathetic. Even the ones who aren't in that position, are very thankful for their jobs and realize that it could have just as easily been them. And most realize that there's no way in hell they would have made it 18 months either. If some don't, and want to judge. Judge away.

Re Discover and how long until they file, I think it depends on how much you owe. They also didn't start calling right away. But when they did, they were relentless for those 60-90 days and then they filed.

Discover has been out of control today. Like I said before, they have been calling, but today they began to call about every 30 minutes. Oddly, Bank of America only called twice so far (odd for them!). I, too, have ATTEMPTED to answer, but literally every time I do, there is no one there. I'm surprised, though, that Chase and American Express have yet to call or send a letter at all.

yeah, it must be that "auto" call stuff...they ring and ring...and the recording says....if this so and so....please hang on...if it's NOT please press 3....if you are a relative...press 10...NO kidding on that....it's ridiculous!! there is usually no one on the other side of the "auto" call systems they use.

don't worry...LOL!! i'm certain chase and amex won't be far behind...just try not to answer.

we have century link and the phone system we have allows us to "block" calls on the home number while verizon allows us to "block" on the cell phones. that's a bill help if you need it.

it will be over soon!! so high tight!

I cannot wait for them to stop. January/February for my filing cannot come soon enough. It's so strange that it truly now has been over a month since I used any CCs AND stopped paying on them. It 'feels' like it's going to take forever, but every single day I am dealing with it better and the time is going by more rapidly.

Today, though, I would like to thank BOA for not calling more than twice. lol

Another late night update. First, I would like to take this time to thank BOA (again!) for only calling... wait for it.... ONCE today. Odd, I know! However, Discover has no officially left voice mail. It was a nice little 34 second one from a lady claiming that she is not a solicitor, insisting she is not actually, and stated that not only did she wish for me to call Discover, they are REQUIRING me to call. They are worried about my account with them and need to hear from me ASAP.

Needless to say, the voice mail got deleted, I did not return the call, and they ended up calling two more times.

What upsets me most is, as I said in a previous post, I *HAVE* answered the phone a few times from them. Said hello, waited a few seconds only to hear nothing. That upsets me more than anything. Oh well.

Still a good day all around. I want to say this again to everyone here or anyone who reads this in the future: it gets better day by day, and quite literally EACH day brings me one step closer to being able to file. That feels incredible and come the end of January when it is filed, I think that I will throw a party. Sounds nice.

i know it's hard when that phone is ringing off the hook...and you know we were much like you in the "beginning" stages...oh i answered the phone and explained our terrible woes to them...i followed it up with a registered letter about our situation and asked please if they could just work with us during our hard times...and the fact that BOA...we had been with them over 50 years really...because when i was a little girl i had my very first savings with them in san fran....

they SOUNDED like they understood...but they didn't care about anything more than collecting their monies.

i even can understand THEIR side of the situation. however, what i CANNOT understand is WHY raise someone's interest rate to 39.9% and CUT our credit line they KNEW we were using to pay a doctor....right in the middle of the transaction...why would anyone do that???

so, we or i got calous about the situation. i got nasty and didn't pick up the phone, and if i did i wished them the best to them and theirs for everything they are doing and don't want to be around when the karma hits the fan!!

i know it's NOT the person at the end of the phone...but sometimes it IS...they are nasty and rude.

pika...just hold on....usually the calls are less during the holiday time...and i hope for your sake that's the case...it will be over soon enough for you!!!

I'm dealing with it pretty well nowadays. I just like updating this thread on the calls due to, perhaps, new people stumbling upon the forum and all that. When I initially came here, I read a ton of threads, even older ones, to get a grasp on things or just to feel better in general.

Today, though, a new call! That's right, after all this time American Express got on the band wagon, even left a message on their initial call. The only hold out now is Chase, but I know they're coming (on a side note, while I have two CCs with them, both of them have, by far, the lowest balances).

As it is, Discover calls constantly, leaves a message every so often (usually a fairly lengthy message that ends up being deleted), and does not block their number. American Express just started calling, does not block their number, and left a message on the first call. BOA sometimes calls every hour, sometimes once or twice a day, they do NOT list their number, only "unknown," has never left a message but did, once, send a text message of all things.

Seriously, I truly do not mind the phone ringing, at least not yet. I can deal with that. What I DO mind is on those times I answer, they are NEVER there, ever. That gets to me.

Chase called my work!! She was very stubborn! I told her not to ever call my work again because it takes a job to pay bills!!

I find US Bank to be tops at the most calls. Started calling day 4 of ever being late.
I have been answering some calls at home because I don't want them calling my ex's relatives (same last name) or my work. I live in a very small town where people love to spread bad news. I always think people are nicer when I go to "big cities".
10/18/10 Admitted to self I can't continue to live off CC; 11/19/10 Filed Chapter 7, 341 scheduled 1/5/11

I hope you'll write a letter to Chase to "cease and desist" from calling you at work. We did it after the first call at work (from BOA) and we never got another call at work. You can send a letter to each address you find for them. Good luck!
