    Collection agency "just received" a debt turned over by original creditor

    Got a call today from a CA. I politely informed her that we had filed bankruptcy (exactly a month ago!), and that I would like their address to send them a copy of the notice.

    She said, "This is a bill from Dr. X. It was just turned over to us for collection." I told her that Dr. X most definitely was notified weeks ago, and perhaps the information was just crossed wires. I gave her our bk info. She asks, "So you have already filed?" I so wanted to say, "DUH!! That is why I just gave you a CASE NUMBER." But instead, I politely answered "yes", and she said she'd make a notation in the file, but didn't need the notice.

    I have notated my file as well ;) 10/27/2010: Received collection call from CA. Notified her of bk case number. Caller stated she'd make a note of it.

    Should I dig up their address and go ahead and send them a copy of the notice?
    Filed pro se, made it through the 341, discharged, Closed!!!

    no...don't bother...just ignore...although...if you get another call you'll need to let them know they are in violation of the automatic stay....and can indeed, get themselves into some hot water if you so chose to pursue this matter with the bk courts...

    you may receive another call...just because things as you said past in the mail...but another call and i would put them on notice ...you can contact the trustee's office if it continues and file a motion against them...

      Yes, definitely if I get another call from them I will state, "As you know from the notes XXXX put in the file, we have filed bankruptcy. This call is a violation of the automatic stay." I'd guess they won't call. She was nice enough, but when in the situation you assume that everyone is trying to sneak in a back door to get you to pay something. Definitely puts your defenses up, doesn't it?

        it most certainly does...however, someone, whom shall remain nameless in THIS very house...actually enjoyed the calls and toyed with the creditors regularly.. it was quite sad, really, for them...as a few times he had them in actual tears...the truth..honestly. i personally believe that once we made our escape and left town and had a new unlisted number he went through...."harass your creditor" withdrawal....LOL
