      Just wondering, how long after you stop paying credit cards will they start filing lawsuit against you and perhaps request for garnishment? I mean I'm in the same boat and never paid CCs since Oct or Nov 2009 last year and been referred to various CA now. Some, I send DV and the 3 CA's recently, I didn't sent any DV at all since considering BK. Anyone have at least a ballpark timeline on how soon they file lawsuit nowadays.. I'm still in a midst of finding the right atty for me for BK so pls help!

        TImelines vary. I read about people sitting in half a million dollar homes who never see a suit. I own squat and was sued at the charge off date!

        I have five accounts delinquent...I can afford most of them. Three are going on a year and the closest is that one has hired a CA/law firm with lawyers in my state. The fourth is at the 9 month mark and hired the same firm. The fifth filed a lawsuit at the six month mark, but I had already initiated arbitration when they did this (a huge violation) and it was dismissed/nonsuited.

        So YMMV.
        First consult: You go now, no CH 7 for you. You spent entire buffet. 13 has a 95 percent payback. (Owwwch) On to next consult....

          No real clue. Chase went for months, but my Lowes card started making the threats after the first missed payment. I don't think there is a hard and fast rule anymore, even within these credit card companies.

            And Broke...your lawyer's point is moot. It does not matter if you don't see a dime, which I suspect you will. Getting a judgment on the books is what you want with these guys.

            They know this, BTW....and most will settle before you see the inside of a courtroom. Had one settle already (a CA not known for breaking rules), one is dragging their feet and asked for one more week before we file suit (maybe because they had to pay out a massive fine recently for doing what they did to me). The third blew off the lawyer completely and will have a suit filed this month. I am filing a small claims about a fourth....who had a suit filed against them by someone else on the 5th of this month, and it was dismissed by plaintiff on the 14th. (That is one fast settlement!)

              Thanks for info, flyinbroke.. I'm 12mos behind on my cred cards and so far no lawsuit yet but 1 of them hired lawyer in CA to collect debt from me... all of them in collections now. Still weighing in if bankruptcy is solution or can settle..

                Well the 26th has come and gone (their deadline for me to pa without validation or they were "going to make me blink"). Nothing so far. Tried calling them morning, asked for either a supervisor or an attorney; I was asked why told my business was with their boss not them; they kept me on hold for a bit; then some gruff sounding woman got on the phone asked if I was ready to pay; I said no but I had a tape she might want to listen too from her agencies prior phone call to me; pause, "just pay the bill! why do you have to make this hard on yourself!" and she hung up.

                Oh well., I'm sure I can find a lawyer who would be interesting in listening.
