Update: FIA has proven their case, that they are Bank of America, and their attorney spoke to my attorney, and are only willing to settle for 25%, payable over 6 months. Else we go to court this Thursday. My attorney states this is a good deal, don't see my case as being defensible. Help! Thoughts??

I'd say that depends on what you can afford. Make a counter offer but give them a reason to bite.
Like 10% spread over 3 months--they'd get their money quicker so they might go for that. Or if it's the monthly amt that's giving you trouble, offer a monthly payment that you can afford but spread out over more time. But if that doesn't mean that your settlement total is higher, be prepared for a a counter offer from them--or even court papers.Don
