    Thank you I appreciate all your advice. Would our mortgage payment be in the plan or could we pay that outside the plan??

      This depends upon what your jurisdiction requires. Some have a "pass through the Trustee" requirement others are "direct pay outside the Plan". Find out who the 13 Trustee is and call him/her. It is much cheaper (no additional Trustee fee) if payments are direct and it may depend upon whether or not you are current when you file. Also, your jurisdiction may have a "model Plan" form. Ask about that as well.

        Going back and reading your case, I see several flaws. First flaw is getting back into debt. One of my pet peeves about the race to reestablish credit right after discharge. As Flamingo says, a credit card is a snake in your pocket.

        Next flaw is you are not trying hard enough to find a hungry bk13 person. They all know they will be paid, or you will not be discharged. They will take it off the top.

        Next flaw, barring lack of lawyer, you are not willing to try to learn pro se' and since there are easy to read books such as C13 Nolo Press, and many people here have gone through C13 pro se', you are not willing to try. Finding a lawyer even in another city or the Internet with phone follow ups, there are lawyers. You aren't trying hard enough.

        The alternative is, suits, garnishments, levy's phone calls fore a very long time and you will be drained further. Cannot help you, only advise you to help your self. As frustrated as you probably are, so am I in that if you do nothing, lose resolve, you are doomed to your own fate.

        I want to hear one of your next posts announcing you have found a reasonable lawyer. Keep trying and read all the stickies on pro se', C13. 'Hub

          I appreciate your advice, yes I am well aware that getting back in debt was a big NO NO. They were some circumstances ( hubby got laid off now makes HALF his income) but we should have stayed debt free to begin with so I do understand what you are saying. BIG FLAW

          I know there is tons of help out there but once again I have seen people totally mess up their own so I wouldn't even attempt a pro se case I just don't feel comfortable even attempting that

          I know I have to keep looking until I find one and that is what I am attempting to do, it just get frustrating that is all I am saying.

          Thanks again for your advice. I am hope I can post soon that I have finally found one that will help us. I will keep you posted.
