    Collection calls, no letters

    So, I've got this collection agency calling me.
    Long story short, had a futz up with my bank, an account that was supposed to be closed was forced open for an auto debit, I had no clue, bank charged off the overdraft fees and sold the debt. I found out when I went to open a new bank account and was told I was in Chexsystems.

    Went to original bank to say "WTF???" and discovered what had happened. Bank basically admitted that it was an error (I had other accts with the bank, and at no time over the MONTHS that fees were accumulating did they ever tell me, and they stopped sending me statements on the 'closed' account) so they did REMOVE my name from Chex, but corporate office (big national bank) said they couldn't do anything about the $$ bc they'd already sold the debt.
    They told me who the CA was. I never heard a WORD from that CA. however, I recently started getting calls from another CA, who must have bought the debt from CA #1.

    I have never recieved ANYTHING in writing. I did talk to CA #2 and told them to send me a written statement of the amount owed and I'd see, but until I get something in writing, I can't do anything about it. I even made sure they had the correct address.

    That was over 2 months ago. They call every day, but still won't send ANYTHING in writing. Not a single demand letter or anything.

    What to do?

      Well I know which numbers are them (they change the numbers but it's always 877) so i just don't answer, since I already talked to them and asked for something in writing.

      Can they sue me or will they just keep calling? We're talking hundreds of dollars owed on the debt, not thousands.

      As long as it's not going to result in a judgement, I'm perfectly happy to continue to ignore them, I just don't want to be blindsided.

        That said:

        Can they sue? Yes, that's not the question that needs to be answered. Will they sue, that's the question you need to answer. And the answer is: Maybe. You say a few hundred, but they're going to stop and see if they can jack that number up with interest, penalties, "attorney" fees. There's no magic number, just what they (the collector) see as the best chance on return on investment.

        As for calls: Yeah, they'll keep coming. You can get Google voice, block their asses or send it to voicemail, you can send them a order to stop calling and that MIGHT stop them.

        But no matter what, I wouldn't hold my breath on getting anything in writing anytime soon. You need to send them two letters, certified with signature return: A written demand for debt validation, and a Cease and Desist all phone communication. After that, don't take their calls, restrict all communication to writing.
