    Contemplating answering the phone

    I got my Chapter 7 filed last week so my creditors will soon be receiving notice of it so far as I know.

    I have a dismissed Chapter 13 and when creditors began calling before that filing one of them asked who my attorney was when I informed them that I was filing.

    I'm pro se this time around. If some creditor or one of my creditors' henchmen call me and ask such questions, what should I say? Why are they asking the name of my attorney anyway? (Do they think I'm bluffing or do they want the information in case they decide to file suit?)

    Since I've been in the process of filing after a dismissal in another state, I haven't had a lot of creditors hassling me so haven't been following postings in this part of the forum. Please forgive if this seems an obvious issue.

    Creditors ask for your attorney's name 1.0 to verify that you truly have retained and are serious, not just a stalling tactic, and 2. they might want to try and send settlement offers.

    I believe you need to inform them that a case has been filed, pro-se, as of XX date, and provide them with the case #. That should suffice. Of course, thwey will also be notified by the court.

        I agree don't answer the phone if you can avoid it unless your in the mood to have a little fun. I've made the mistake once or twice..one bill collector asked me if I was moraly bankrupt as well when I informed him I would be filing! funny thing was this was perhaps the most crooked company I've ever dealt with...anouther collector called back after I told them I was in the process of filing and left me a 5 minute lecture. I've even had a couple tell me their debt was not dischargable and bankruptcy would do me no good (untrue). A local gym told me no lawyer or court would make them go away...

          Nothing wrong with answering the phone. Just answer, give them your case number, and they should go away. It's none of their business who your attorney is, because they can find everything they need on pacer.

          It normally takes about 2 weeks from filing for everyone to get the info into the systems, and most will be polite about your filing.

          And for the ones that can't stop calling? Those are the ones that you document and make $$$$$ from.
