No problems. Zwicker...I just dont know about those folks. Their's just a odd breed of hellish collector. I think they get their call center people from the soulless and unloved Korean knockoff Cabbage Patch Dolls. They will badger, and insult, and grill you, till you just want to reach through the phone line and pull back through.

I'm not telling anyone to do what I do or did. It's probably isn't a good ideal to be such a wise-a$$ to these guys. And the good-lord knows that it wouldn't be the first time my mouth has wrote a check my @$$ has to pay. I'll go as far as to say that it's probably dog-stupid what I'm doing. But I don't care, I can't care. If I care, if I worry about it, it'll be just one more straw on a camel whose back can't take anymore.

I sincerely believe, with no trace of humor, that if the economy doesn't turn around, and soon, and collection regulations aren't tightened up more and more of these scum-suckers put to account for their actions, that they're going to start driving the desperate people into taking violent action against debt-collectors.

Got off the phone with Zwicker an hour ago: Now they're demanding I hand over my parents' bank account info or they're going to sue them (note: my folks aren't co-signers or in any way involved in any manner with the bill in questrion.) I was laughing so hard at the woman. She was blustering on and on, and that I eventually just hung up on her.

This is where I hope you taped the call, or can at least memorialize it to paper. You may have your countersuit against them...or can jump the gun and go after them first. State laws can add a little more change to your pocket too.

just a thought...get to your nearest legal aid center and ask all of the questions that are swimming around in your head. I defaulted on 13,000$ of unsecured debt and I am judgement proof...I have no job, no bank account, no assets, and an exhaustee of unemployment benefits. (99er) Since you have a modest income who knows what the bottom feeder bill collectors will do. In Las Vegas right now there is a case where a processing legal company is being charged with tainted default judgements,submitting false affidavats and more. Just terrible how many people lost their jobs or were denied unemployment and so forth. Too much info to go into (if anyone is interested google, Las Vegas Review Journal, (9/11,2010)and Rapid Cash...

please brokein2010, do not call or answer the phone concerning your bill collectors. Always deny that the debt is yours and never, ever give bill collectors your parents name, children's name, spouse's name , even your pet's name etc...nothing...Send a cease communication letter asap, certified...and I have mentioned it before( View, Dateline episode, Debt Trap, March 27,2009 and become sickened by the evil tactics of debt collectors)...I applied for a job on-line and a bill collector is calling a previous employer from 5 years ago demanding information...the nerve..

most of all,
do not stress out...there is no debtor's prison...
do not let a debt collector hold you hostage..

We're only talking to them cause our attorney wants to keep the "lines of communication" open till we can file our Ch. 7 (8 months and counting down)-- plus he's hoping they'll slip up and he can go after a couple of them, he has a real hate for Zwickers & Assoc.

Definitely the CCs are suing - just look at all the liens on property they're getting in your area, if the registry of deeds is online.

Collector: Are you sure Mr <my name> is unavailable?

Me: Yeppers.

Good for you. Any time someone can twist the n-ts of these guys, so much the better. I really , really, loath Zwicker. Not just becuase their bill-collectors, but cause of the crap attitude and the way they just bulldog ya' and dance around making cute little "half' threats.



Note: I'm sick, I've not slept, I'm running a low grade fever, and it's been the week from hell medically. I'm no mood to be nice to anyone.

I think we just went to "stupid". Few minutes ago (same woman) wanting to know how I was going to afford a tent if I can't pay my bills (head meet desk).

Me: "you're right...well looks like I'll be living in a box."

Her: "Boxes cost money."

Me: They just stick a phone your hand and pull the string don't they?

Her: ... did you just insult me.

Me: So that's a yes?

Her: This call is being recorded.

Me: Great, wonderful, then let me says this to your attack-dog bosses: I'm broke.B...R..O..K..E. I could be homeless in a few weeks. I might have to send my wife and kids and out of the country to live with in-laws till I find a job and a home. Now, if I had money to pay you, don't you think I've got better places to spend it?

Her: Sir, the payments only $500 a month for 6 months.

Me: And right now we're only bringing in a little under 600 a month and I've got keep lights, water, and food in my kids stomach.

Her: So you're saying you're refusing to accept our fairly offered payment plan?

Me: I'm saying your payment offer is idiotic and if you keep calling back I'm just going to continue to make fun of you till I get bored and send a cease and desist letter or you screw up in some way and I sue you and your bosses out of business. That's what I'm saying.

Her: (frustrated) What the hell do you want me to do? You tell me you've not got $500 a month but you're talking about buying tents and boxes and houses...and...and...WHAT DO YOU WANT?

They called back to today: They'll not "escalate" if I agree to $300 a month with a $500 "deposit". :lol: When I said there's just no way it was going to happen (financial situation as gotten worse) the customer service rep said yelling (just blew up) and screaming about "faud" and "theft" and rambling on. I hung up laughing.
