Yeah it does seem odd that they want to know financial info of family members, especially ones that aren't US citizens.


Round 3 with Zwicker this morning. B---h was harping "you know we can take legal recourse".

I told her "just say "sue", you are going to "sue" my ass" . She said I need to stop "bullying" her. I told "tell ya' what, I'm about to lose my home*, send the summons to the tent I'll be living in the a few weeks" and hung up.


* - Mom's (who holds the deed) creditors are seeking a lien and one threatened to force a sale. So, yeah, I'll be moving in with family or on the streets if they follow through.

Well, I'm unemployed so they asked who is paying for our expenses. I told them that my grandmother jumps in sometimes and sends some money. And yes, I was asked "how much money" she would have although I agree that this is non of their business. After all, HER money is NOT my money..

Once they start the precedure and tell me that "this is an attempt to collect a debt", I'll ask them "oh, is this so?"

"You are hereby notified that I filed for Chapter 7 BK. An automatic stay is in effect. In case you continue with the deposition, please be advised that I reserve the right to sue you and/or your client for the violation of the automatic stay."

Since it is a deposition, my "warning" will be recorded by the court-recorder who is going to be present.

Good for you. Any time someone can twist the n-ts of these guys, so much the better. I really , really, loath Zwicker. Not just becuase their bill-collectors, but cause of the crap attitude and the way they just bulldog ya' and dance around making cute little "half' threats.

I think we just went to "stupid". Few minutes ago (same woman) wanting to know how I was going to afford a tent if I can't pay my bills (head meet desk).

Her: "Boxes cost money."

I might have to send my wife and kids and out of the country to live with in-laws till I find a job and a home. Now, if I had money to pay you, don't you think I've got better places to spend it?

Her: Sir, the payments only $500 a month for 6 months.

Me: And right now we're only bringing in a little under 600 a month and I've got keep lights, water, and food in my kids stomach.

Her: So you're saying you're refusing to accept our fairly offered payment plan?

Me: I'm saying your payment offer is idiotic and if you keep calling back I'm just going to continue to make fun of you till I get bored and send a cease and desist letter or you screw up in some way and I sue you and your bosses out of business. That's what I'm saying.

Her: (frustrated) What the hell do you want me to do? You tell me you've not got $500 a month but you're talking about buying tents and boxes and houses...and...and...WHAT DO YOU WANT?

I had one call (not Zwicker) call last night and gave her a polite, long winded, 20 minute lecture on semantics and using the right words to describe a situation. Never raised my voice, never insulted her, 20 minutes in she sighed and said "I'm not a child, I don't have to put up with this bullshit" and hung up.

Best line ever. And it went completely over her head.

Just the way my granddaddy taught me to do it.

Meh, I was in a mood and decided to play, that's all it was. Back in the day (20 years ago) I used to drive teachers nuts doing this sort of thing. Now I play with pissy little collectors.

cue 20 minute long one-side convo, with her sighing every so often and a whispered "Why can't I just hang up on this guy?"

I've also been known to tell them (when I'm on my cell) that I need to go take a piss and that they're more than welcome to talk to me while I'm in the men's room. Only a couple have dared to risk it, and hang up quickly when they hear a flush.

Wife said the same thing when she was watching, laughing, as I played with one of the collectors a while back. All though she said I'd have to make it a fiction book to keep from getting sued.

I woke up one morning and said "F--k it! What do I have to lose" and just started being a smart@$$ to these guys.

It's like I tell people: We're in a situation that could end with us losing everything. It's not a joke or a put on when I tell 'em I might have to send my wife and kids out of country to live with her family till I can get us a home. I've got a stack of medical bills that I have to pay for the baby, and some a-hole is telling me to put my kids up for adoption. I wake up in the morning and hit the comp putting in job apps and bidding on media design jobs. I'm sleeping less than 4 hours a night cause I'm busting my nuts looking for work that isn't going to come. I'm hassling friends for jobs and job references for everything from scrubbing toilets to flipping burgers and still can't get a job. If I stop and think about it to long and take it serious all the time, I might just snap in a bad way.
