    Is Discover Card joking ?

    Received a letter from Discover today.

    About a month ago I received a standard notice from Capital Management Services, Lp(debt collector claiming to have been 'engaged' by Discover Card)pertaining to this account giving me 30 days to respond.

    In turn I sent Capital Management Services a DV along with a Cease& Desist. (BTW..I don't sign any DV's or C&D's because for one: none of the notices that I receive from collection agencies have a signature on them, and the other reason: I don't sign these letters because I don't want my signature to be misused/copied.)

    Here is how the letter from Discover is worded:

    'Dear ........:
    We have been made aware of your dispute. In order to assist us with our investigation, we are requesting the following information:

    * A copy of your driver's license or an official document containing your signature
    * A detailed letter including any documenttion to substantiate your dispute

    Thank you in advance for your assistance in timely resolution of your dispute,

    ( printed name of person)
    DFS Services LLC

    This is an attempt to collect a debt and any information obtained may be used for that purpose.

    My first gut reaction was: you have to be kidding....official document with my signature ?...sounds as if they need to fabricate a retroactive agreement with them with my name on it ?
    'I' should write a detailed letter including any DOCUMENTATION to substantiate my dispute ?...Halloooo...

    Anybody else received a letter like this ?
    Anybody actually responded to something like this ?

    I am wondering if I should send Discover a DV or, since I already DV'ed Capital Management Services, just forget about sending out another DV to Discover ?

    This is a side effect of the new FACTA act, which replaced the FCRA.

    They're interpreting your DV as a dispute which they are required to investigate. At some point they will rubber stamp the investigation as complete and move on with their collections. In the meantime you'll probably receive a multi-pounds mailing from the post office with all your statements for the past few years.

    It is called the "red flag" rules. Might help sow a little confusion and buy some time for someone.
