Chiti will sue. They do not appear to be a creditor that sells your debt to a JDB. They have sued me twice for two accounts. One account $9K is now about $15K and the other aother account is in my "answer" period for the lawsuit. It costs a lot of money to answer a non-small claims complaint in my state, so they can get a default judgment. Big deal. The plaintiff's attorney has not even attempted to garnish my wages for the last judgment. I think this may be due to the fact that I am on a permanent 15% student loan garnishment and that only leaves 10% for the other vultures.

I'm pretty happy. I see a chapter 7 in my future 5 - 8 years from now. Of course the Feds could change the law but I think if anything the BK laws may become more debtor friendly. I'm still living fine (lovin' life) on 75% - 85% of my take-home wages. Most folks that I know are paying 15% - 30% of their takehome to unsecured credit card debt. I figure I'm doing better than they are.

I know they'll sue. I'm hoping to be able to make them an offer before then, though. Hoping they wait until March.

I'm wondering if maybe because of the foreclosure and the fact that Discover started filing that they are waiting.

We haven't paid them in a year.

Here in ga the statue of limitations is 4 years. Is that the time frame to sue and collect? or just to sue? if so then whats the statue on collecting after a win

I'm pretty sure once they have a judgment, it can be used whenever. I think it's 7 years to sue.

I thought it was 7 years all over.
