    Whoohooo!

Discover settled for 40% of the original balance. They were willing to take it in payments over 6 months.

They signed for the first check yesterday! Can't wait until this stuff is done with!

Hope you got in writing that they would not sell off that 60 percent. They have a way of sneaking up on you later.
First consult: You go now, no CH 7 for you. You spent entire buffet. 13 has a 95 percent payback. (Owwwch) On to next consult....

I got it in writing that they would accept it as paid in full.

To answer the questions- I haven't paid my cc's in about a year. I started receiving calls right away when I missed my first payment. They called at least once an hr when they had my number.
Then I moved out of state.
They filed a suit against me in my old state, but never moved forward with it (because they couldn't find me)
When I saw the suit on file- I called and made them an offer of about 25% (that I knew they wouldn't accept) they said they would accept 50% of the total balance, with all the fees added in. I then offered 40% of the original balance (without all the fees) and casually mentioned bankruptcy and that this was the best we could do.
        and they accepted.

Thanks, Jacko- you are always so positive.

I will owe the irs less than what I would have paid Discover had I filed or let them garnish.

No where close. High dmi. and we can pay it without bankruptcy so we think that we should.
