In jail for being in debt

    #2
These people are missing court dates and a bench warrant is then issued by a judge for contempt of court.

Your title is misleading at the least.

That is the title of the article. If you read through the article, there was a case were a debtor was held in contempt for not paying a debt and locked up.

They were not thrown in jail for being in debt, there was more to the story...like blowing off court, not responding to paperwork, not responding to judgment orders. All of this is contempt of court, which you can be jailed for. Plus it is MN, which supposedly has the most creditor friendly laws in the country.

        Moral of the story:

        1. Blow off NO paperwork and NO court date. Respond, respond, respond. Respond again.
        2. Keep tabs on court dockets and filings. We know that CAs love no-shows as it is default judgment in their favor. Some people are afraid, some CAs deliberately send summonses to the wrong address. Whatever happens, don't give them the easy win.
        3. In over your head? Seek legal help.
First consult: You go now, no CH 7 for you. You spent entire buffet. 13 has a 95 percent payback. (Owwwch) On to next consult....

            And it's still total B.S.

You don't go to jail for not paying your debt. You go to jail for giving the legal system the finger.
