    Can the IRS do this?

    Quick Rundown:
    My BF lives with me and owes the IRS money, they have sent him to collections.
    My employer is a bank, and my BF is listed as my domestic partner (through my employer) for medical insurance. ALL accounts at the bank are in my name only.

    He received a letter from the IRS collections yesterday that says they are sending a levy to MY BANK.

    I am furious! I don't want it tracked to me, when it is not legally my debt and this is my employer!! My BF is calling the tax attorney today to see how much it would cost for assistance with a Offer in Compromise, but odds are slim we can afford it. He has been diagnosed with cancer and is unable to work due to his treatments of radiation/chemo.

    What are the odds, if any...that they can somehow attach this debt to me?
    Michigan is not a community property state, and we are not married.
    But because we have the "domestic partner" status through the bank, does that change things? My employer/bank is very picky about it's employees getting these kinds of things.

    I suspect they are attaching my bank because in the past I have sent money from my account to the IRS on his behalf. Does this change anything?

    If he has cancer and is not working, he should really be seeking tax assistance. They can mark the file as uncollectible for a period of time. I'm assuming that he just ignored all the warning letters from the IRS and never tried to deal with the issue? Just asking.

    The IRS probably used the old payment information from your bank, to trace the account. However, when they issue the levy, the name and SSN won't match on the account. I would not rest on that, though. Immediate action needs to be taken. An IRS levy is serious business.

      He has sent (or had me send) in money from time to time, to the IRS for this debt, but not enough it seems. Today he is calling the tax attorney to see what can be done, and hopefully we can afford what they want to file the OIC. With him unable to work and no income, our options are very limited. My check can only be stretch so thin, you know?

      Because his SSN and name will not link to my bank accounts, my paycheck should (hopefully) be untouchable until we get something going with the tax attorney. *sigh* Like we need all this now!!!

        I'm hoping that they just mark the file as uncollectible.
