    Do I need to worry about this?

    Last year, I broke an apartment lease because I was laid off from my job and had to move to where I ended up getting a new job (3 hours away in another city). Of course, they charged me over $2k for breaking my lease, which I could not pay. So I included this debt in my BK 13 filing last month. I listed the collection agency that was handling the debt in my BK filing. But a few days ago, I received a letter from a different collection agency trying to collect on it. I'm assuming the old CA sold the debt to a new one when I didn't pay, but the old CA would have been notified of my BK. Is it my responsibility to notify the new one that the debt is included in my BK under the other CA or should the old CA notify them? With the rate delinquent accounts are sold these days, how could I possibly keep up with it? I suppose I could give the letter to my atty, but the petition has been filed already and I can't imagine I would have to amend every time something like this happens. Any ideas what I should do with this?

    I was told my my attorney that it was not my responsibility to try to keep up with who owns a particular debt at any given moment. If you included the original debt, and the CA at the time of your filing...the rest isn't your problem.

    If you want them to stop bugging you, send them your BK case # and your attorney's phone number.

      When they call, just smile and give them your case number. You don't have to keep updating this. Someone just has not placed in the system that you've filed yet.
