Citi lawsuit

Help guys what can I do.
Being sued by Citi, they have these bottom feeders here in CA called Hunt and Henriques.
The summons never came to me, went to a previous address. So I appeared at an OSC meeting in judicial court where I was given 60 days to file an answer by the court clerk. Have to go back to court tomorrow having filed my answer but in checking case summaries on the website I see that the judge has already ruled in favor of the plaintiff, the bottom feeders filed a motion for summary judgement and the judge made a ruling on Feb 11th.

Do you have any correspondence between Citi and you from your current address? They are obligated to serve you at the most current address they have for you. H&H are bottomfeeders and would without a doubt "accidentally" send it to your previous address. I would seek to have the judgment vacated on the basis of lack of service. Keep in mind the judge may agree, vacate the judgment and hold a mini trial right then and there, be prepared to defend.

What is your "end game" here? Are you going to be filing BK? If so, I'd do it now.

How many payments did you miss until they sued?

You would have to claim lack of service on the SJ motion papers.

good ole H & H. They had 6 of my accounts. Thats why i got moving and filed, because i knew they were not joking. when my attourney saw them on my creditor list, he said good thing your filing........he was pretty aware of them.
