    what is considered "excessive" phone calls?

    Just wondering... my husband and I retained our attorney and our paperwork is being processed. We have informed all of our creditors and gave the name and # of our attorney. Chase CC is now calling.. well, I just started counting, approx. 5 times per hour. We don't have a docket # yet so I know they can continue to call, but is this number of calls considered excessive?

    Nope. They can call as much as they like, unless your state has laws that count towards the OC as well as CAs. The FDCPA only affects CAs.

    However, they should have stopped if you retained your attorney unless you are filing Chapter 7. Attorneys have to by paid in full in a 7 for a BK to take hold. If you filed a 13, I am pretty sure that they have to stop once you give them a lawyer's number since he gets paid out of your BK.
    First consult: You go now, no CH 7 for you. You spent entire buffet. 13 has a 95 percent payback. (Owwwch) On to next consult....
