I finally found the courage to pull my credit report this morning. I have 5 credit cards that I haven't paid since Feb 2009.
All CC's are reporting " Account charged off. $XX,XXX written off."
Responsibility: "Individual" OR "Joint w/husbands name"
I know that a "charge off" does not mean that I am free from the debt and the cc's or collection company can still sue me for up to 5 years.
However, My question is.....CAN THEY SUE MY HUSBAND ON THAT DEBT SINCE HE IS NOT LISTED AS A RESPONSIBLE PARTY TO THE DEBT?
I'm assuming that they can not, but he is listed on 2 of the 5 cc's that we have. If they can only come after me on 3 of them, that would possibly put up a barrier to some of my concerns with collections. However, I am listed on some of the assets we own, so I suppose that's a concern too. I am self employed so a judgment against me would not allow them to garnish my wages.
