    GEMB/Sam's Store Credit already sent to NCO

    Got the letter today...

    Now if I DV them, am I just doing that to buy time or what?

    If NCO JUST got the account, how long before we seriously need to worry?

    We're in TX, so I know they can't garnish, but I don't want them to levy our bank account or get a judgment.

    I supposed I should add that the last payment to GEMB was in Nov.

    So we missed Dec, Jan and Feb., but not yet March (because the account wasn't due till mid month) Seems quick to send to collections but....???

    GEMB is notorious for turning over to collections quickly. We have 4 accounts serviced by GEMB and we also stopped paying in late Oct early NOV. So far they are the only ones who have sent to collections but not all the same.

    The DV really doesn't buy you anytime but it won't hurt to send to see if they go away. You have at least 30 days from the date of the letter and then they may or may not take any more action for who knows how long. Of coarse after the 30 days have passed they could also sue but I would highly doubt it.

    If your filing anytime soon I would just ignore the letter.

      We had hoped to wait till the end of June now.....so we need to hold them offf for 4 months if we can.

        You should receive a letter of intent to sue if they are serious about suing. I wouldn't lose any sleep over a "pay us blah blah blah" letter. I have received several and still haven't been sued. I am also in TX, the 'debtors haven'.

          NCO goes away promptly after DV, a bunch of my accounts were sent to them, they suck, not aggressive, and skimper away with their tail between their legs.

            yep GEMB. of my 25 CC's the 2, I had with them went to collections first. Yes, send NCO a DV. They will go away, and after a few months you will get a letter from some attorney trying to scare you.
            Stopped Paying CC's 2/2009. Retained Attorney 1/10/2010 Filed 1/23/2010. Discharged 5/19/10 $187K CC, $240K 2nd,$417K 1st, No asset Ch-7

              Ditto. From our experience NCO must look for the low hanging fruit. If you scare easily and pay, they win. If you don't or DV they don't put much effort into it, other than monthly love letters.

                  I defaulted on all my cards last July. Most are set to charge of this week. I just got a call the other day from NCO on one of my accounts and the caller barely spoke English and I had no problem not telling him anything other than to confirm who I was. Don't want them calling neighbors/family. Don't know if they will call again but we will see. Seemed too easy.

                  All of the collection agencies so far, on all my accounts, have been fairly easy to deal with and after a couple of non-productive calls, they back off. I only had to send out one C&D (The CA was calling multiple times a day even though I was confirming who I was.) and that was in November.

                  Valentine & Kerbartas has been the sleaziest so far and they tried to intimidate me by appearing to be a law firm that had bought my debt when they called the first time. After some lengthy research, on the net, I found out they were a bunch of bottom-feeders that got slapped in July 2009 with the largest fine in history for multiple violations of the FDCPA. The fine was in the millions. I found out they were not lawyers nor had they bought my debt. Next time they called I told them I don't talk to lying debt collectors on the phone that routinely violate the FDCPA. So far I haven't heard another peep out of them.

                  I check the county court system every day to see if any of my creditors have filed a law suit-so far none. I am collection proof but I want a heads up to get what little money I do keep in the bank out in time.
