Several months ago Portfolio Recovery started writing my wife regarding an old CC account that had been charged off by Providian 10 years ago. Balance of only $300. My wife was all ready to start paying them; I said, "no." Sent them a DV letter some time ago. Got a rather rambling reply about 6 weeks later showing original creditor, date acct opened, and date of last activity (early 2000). They made it all sound like we were asserting an identity theft claim--which we hadn't mentioned at all. And asked us to fill out a bunch of included forms. I figured they were just fishing for some way to rehook us up with the debt, so we did not respond. Now the letters have started up again. Nice and friendly--just make $10 monthly payments. How do I get these guys to stop writing?

Gotta love zombie debt. I mentioned zombie debt to the hubby one day and he said "What? So the letters that come will demand brains rather than money?"sigpic

In this case I recommend sending the Cease and Desist Communications letter by certified mail. That will shut them up.The world's simplest C & D Letter:
"I demand that you cease and desist from any communication with me."
Notice that I never actually mention or acknowledge the debt in my letter.

when it comes to providian and their goons.thats one that never will give up.at least they didnt with me.i too had to deal with portfolio.told them to cease and desist.then i heard from rab preformance and their attorney.sent them another c and d letter.next letter was a summons for a lawsuit.the only thing that got thru.was the letter of impending bankruptcy.finally i had peace from them....

Say I am curious, I wonder what the oldest debt on record a JDB has successfully tried to collect? I wonder if anybody knows? It is no big deal (I think) but that got me wondering.Chapter 13 filer since Feb. 2018 under a 60 months payment plan

Oh, I've had some collectors rear their ugly heads from time to time with a car that was towed waaaaay back in 1992 owned by my now ex-husband and sold at auction, but still owed towing and storage fees. I still don't know how anyone would want a car that was practically falling apart anyway. I was never on the title (and I still have a photocopy of the title nearly 20 years later), but somehow I got stuck with it too.
So I just fire off a FOAD letter and they leave me alone for a couple of years. They never show on my reports. I should call them and tell them that they need to find the deadbeat and if they do, can they try to get the alimony he owes me.sigpic
