    Car owned by twp people

    I have family member (Not spouse) going to court and may get a judgment against her. We jointly own a car worth about 3500. The title reads "&" instead of "or" in between the names which requires 2 signatures to sell or transfer etc.

    Can this car be seized by the creditor even though my name is first and I wish to keep it?

    I live in WV.

    Don't quote me on this, I'm not a lawyer.

    But it appears that WV gives you a $2400 exemption for your automobile, which should safely cover your 50% interest in the vehicle. That is to say, the debtor's interest. As a non debtor you wouldn't care.

    Secondly the other person on the title complicates things, even if they could legally sell it they would have to give up half the proceeds. They being the creditor.

    So I'd say you're probably safe.

    In general, wage garnishment is the primary tool used for judgment enforcement. Bank accounts, yes if they can be found. Real estate, yes is there is any equity.
