    Collection Letter 3 years after Discharge

    I recieved a collection letter today from progressive financial services for
    the us department of the treasury...whatever that means??

    i filled chapt 7 and was discharged 3/31/2007

    Should I call them or contact them in any way..

    I can't believe this after 3 years ..

    I would contact them (recording the call & send registered mail) telling them they are breaking the law trying to collect on a DISCHARGED debt and to take a hike.
    Stopped paying c. cards February 2009

    Case went without a hitch!

      Progressive Financial Services, Inc. is a well-known national collection agency - http://www.progressivefinancial.com/home_nonflash.htm . According to their website, they manage collection projects for the federal and state governments, and also manage collections for federal educational loan defaults.

      Did you owe federal taxes that couldn't be discharged when you filed back in 2007? Did you owe student loans when you filed?

      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        No,as far as I know there were no tax debts,I don't have any student loans
        and I have never heard from any gov.agency about taxes..

        I don't have any idea what this could be about..but the letter say's with
        penelties and intrest I owe 30K.

        Should I call the collection agency that sent the letter??

        Or should I just take it to my BK lawyer??

          i'd check to make sure there are no tax liens showing on your credit bureau(s). If there's nothing there, and you've received nothing in the mail and know of no taxes owed, I'd just call'em and get the story. Then go from there...

            You need to take the letter to your lawyer that filed your 7. Do *NOT* call this collector directly yourself until you speak with your lawyer.

            If you listed this debt in your Ch 7, then ask your lawyer if you can make a copy of your discharge papers along with a copy of their letterand send it to this collection agency certified return receipt mail. In your letter state in no uncertain terms that they are violating the bk law trying to collect a discharged debt and you will take legal action if they do not desist immediately. That will do the trick 99% of the time - the collector will move on to greener pastures and you'll never hear from them again.

            If they are stupid enough to continue to press for payment after your letter even though the debt is listed on your bk creditor list, then you and your lawyer can sue them and you'll win, too. You wouldn't mind getting a little cash out of this collection agency, would you?
