Can the OC call multiple times a day after speaking with you once?

    Can the OC call multiple times a day after speaking with you once?

    Can the OC call multiple times in one day after already speaking to you that day? I thought they couldn't, but maybe that is a CA that isnt supposed to do that.

    I talk to Chase in the morning, and it is 11 and we are on call 17 after a 20 minute conversation with them. No big deal because it is set to go straight to VM, but I was just wondering.

      Two. And one student loan. One Chase is my husbands, one is mine and the student loan is mine. So three conversations each morning at about 830 to 9- essentially - and the calls dont stop all day until 9.

        It may be because you have multiple cards/accts with them ...in the case of Chase, I find after a conversation with them, I can go a week or so without any calls at all.

            Chase is the original creditor and not subject to the FDCPA.
            Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

              That is kind of what I thought Ohio. But it still doesn't seem right that after talking with them I get 30 calls a day.....but I know, I know, we are not dealing with right and wrong.

                Yeah, I spoke with BoA last week, and they told me the calls would not stop until I paid. They called five more times that night. Because they are OC they don't have to follow the FDCPA, though I had heard mumblings on the interwebz that Texas law makes harrassment illegal. Does 20 calls from blocked or fake numbers constitute harrassment?
                First consult: You go now, no CH 7 for you. You spent entire buffet. 13 has a 95 percent payback. (Owwwch) On to next consult....

                  Again, it goes back to "well what am I gonna do about it" because I personally think that after they talk to me once (even twice) a day and get the same answer it should stop for the day. or the week if they are smart cause my answer prob isnt gonna change. But I digress, I am the one not paying.....

                      They will call numerous times because statistically, people will give in if they're pressed enough.

                      It wouldn't surprise that the numbers could be different. Instead of one person calling you, 2 or 3 different people call. Of course there's no note on the account that you were already contacted by so-and-so. LOL....if that was the case, it would be proof that they're pushing the limits and getting close to crossing that fine line of breaking the FDCPA.

                        There are some pro consumer states that have state statutes that include the OC as well as DC's. Their state statutes mirror the Federal statutes and cover OC's too. For example WI and TX are extremely consumer friendly. Check this link for your state to see if you have protection under your state's laws: http://www.privacyrights.org/fs/fs27plus.htm

                          Oh my...here is what Texas says:
                          State law prohibits the use of harassment and abusive collection tactics. It is illegal for any debt collector to:

                          threaten violence or other criminal acts;
                          use profane or obscene language;
                          falsely accuse the consumer of fraud or other crimes;
                          threaten arrest of the consumer, or repossession or other seizure of property without proper court proceedings;
                          use the telephone to harass debtors by calling anonymously or making repeated or continuous calls;
                          make collect telephone calls without disclosing the true name of the caller before the charges are accepted.

                          And in TX, this applies to ALL people trying to collect on debts. Time to send out letters to BoA since I know they are blocking their calls.

                            What really pi$$es me off are the CA's that use number blocking, or have their caller id set to 000-000-0000. I absolutely refuse to answer any call that is done these ways, regardless of whom they are from.

                              Mine have not gone to CAs yet and they are already doing the 000-000-0000 or "private caller" and I don't pick them up. Now that I know it is illegal here, I may talk to a lawyer and see what can be done. If it is 1K per offense, I have 27 calls from just the past three days! This will pay off BoA AND leave me money left over lol.
