    Collection Practices?

    Morning All,
    I filed for personal bankruptcy on 9.23.05 and had my meeting of creditors on 11.9.05.
    I had two cc's with Bank Of America, the account with the smaller balance they keep calling about. I mean up to 10x a day. Never any messages. I recently received a letter from BoA stating that because I have missed the past 5 payments, they are reporting me to credit agencies 'used by BoA'. Nothing about collection agencies, just that they are reporting me to credit agencies. They continue to send me payment statements every month as well. I have checked the account numbers and I did file the correct account numbers. Lastly, since I filed by myself, I'm kinda on my own.

    any ideas? what gives with the bank acting like I'm just delinquent and not filing bk?

    ANSWER THE PHONE

    No seriously though, answer the phone and try to have a civilized conversation with them. Maybe thier BK notification got lost in the mail or something and they just don't know you filed BK. Next time they call answer the phone and have your BK case number ready.

      Yup, what Sleepless said: answer the phone and in your most civilized voice inform BoA that you filed BK. You might want to ask to speak with the BK department (given BoA's size I am sure they must have a BK department). Give your filing date, case number and date of your 341. Write down the date/time/and person you spoke with. Inform the CSR that if you continue to receive phone calls regarding this debt that you will have no choice but to inform your BK trustee that BoA is violating their stay order.

          no sweat, customer service lady took the minimal info (case #) and the phone has been quiet.

          now just to make it till Jan. 9th

            See, now wasn't that alot easier and less nerve racking then letting the phone ring all day?

              Was probably a simple error on their part, or lazyness by whoever entered it on the other account. Even if you had listed wrong or partial account #'s, simply listing them as a creditor is enough to cover you.

              Glad it is worked out!
              Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
