First, if you did not show up, you would either get a bench warrant or a default Judgment against you. This Judge did not show up TWICE? I'm not sure if you have a lawyer, but this case could be dismissed or the Judge censured.

Next, if they have an active suit, they cannot sue you again for the same thing or in a different state. The venue is where you are.

Are you going to file bk? This will stop all. If not, wait for the next, if ever, hearing. At that time, you will be given (normally) a right to mediate.

There are even times that judges can't make it to court. Illness, military service, possibly testifying in another court, a case with a venue change forcing him/her to travel out of county, etc. It happens.

In this small town we only have two superior court judges and the judicial circuit actually covers two counties. If a court case in the neighboring county runs long it really puts a monkey wrench in our court docket and the reverse. To make matters worse, with the state required furlough days to make the budget stretch there have been even more backup to our dockets.

Of course, if you are the defendant this is a good thing. take any delay you can get to give you more time until you are ready to file.

To the OP could the account have been sold or transferred involving these banks changing hands recently? I know several banks or parts of banks have been bought out by other banks sometimes even within the same company.

Citifinancial will bounce accounts around the different branches. I don't know why, but I assume it probably has something to do with spreading around losses so one branch does not look worse than another.

They MUST sue you in your county, they can't suddenly decide to sue you in another jurisdiction.

Stuff like this was done to us. What I did was document and kept records on everything. We did get some new accounts but when we did not 'jump' on them, the accounts suddently 'disappearred'. I had a gut feeling that when you go to use one of these 'new' accounts, the account has to be activated and when you go to activate it, I suspect the plan is to 'get you'.

You should file a motion to dismiss the suit. It is possible that the current law firm representing citifin may have already done this. Do you know if this was small claims? Go down to the courthouse where the suit was filed and review the file.
