    Potential wage garnishment question

    I have received a summons (in AZ) from AMEX. I have 20 days to respond. Assuming I decline to answer, does anyone have experience (or care to guess) as to how long it would take the creditor to get an order for a wage garnishment?

    Also, although I live in AZ, my employer and place of employment are out of state (I travel for work, and choose where to live). Is an AZ garnishment order applicable to a employer who is not in the same state?

    The only reason I want to hold off of a Chapter 13 filing, is that I am in the process of a mortgage modification through the Making Home Affordable HAMP program (I am in a "trial payment" period).

    Good question! I am also wondering, which states laws apply to wage garnishment, the state you live in, or the state in which your employer is based/located?

    my example. I work for an airline (flight attendant), my airline is based in Georgia (the companies address on my paychecks), but my "base" is in South Carolina. When I go to work I always start and end at my base airport in SC. I am an SC resident. Would I fall under the wage garnishment laws from GA or SC?
